On December 8, 2022 at 9:00 AM, Licensing Program Analyst (LPA) Monique Ayala conducted an announced inspection at the facility noted above and met with Applicants, Yingjiao "Yogi" Kang and Zheng "Zena" Zeng. The purpose of the inspection was to conduct the Prelicensing inspection for a Change of Ownership (Learning Tree Preschool, License Number: 191503389). The applicants are requesting to be licensed for 42 preschool children and 18 toddlers (total capacity of 60 children). The facility consists of 3 classrooms: Toddler Classroom, Preschool Classroom #1, and Preschool Classroom #2. The operating hours for the facility would be Monday through Friday from 7:00 AM to 6:00 PM.

Per applicants, the Sign-In and Sign-Out will be conducted with an iPad using the Procare App, the iPads will be located inside each classroom and a health check will be conducted prior to children signing in on a daily basis.

All areas identified on the facility sketch were inspected. LPA was guided on a tour of the facility accompanied by the applicants. The following documents were posted in a prominent, publicly accessible area at the facility: Menus, Child Passenger Restraint System Poster (PUB 269), Notification of Parents' Rights (PUB 394), Emergency Disaster Plan (LIC 610), Daily Activity Schedule, and Personal Rights (LIC 613A).

Furniture and equipment were inspected for age appropriateness and good repair. Telephone service, heating, lighting and ventilation were evaluated. Children have their own cubby to store their belongings. Napping equipment (cots) were observed inside each classroom. Per applicants, sheets will be taken home on a weekly basis to be washed. The facility will provide children with snacks daily. Parents/guardians will provide children with their lunch daily. First Aid supplies were observed and kept in each classroom and in the office. Per applicants, medication is only administered to a child when accompanied with a doctor's note and medication will be securely stored in the office.

Per applicants, the isolation area is located inside the facility near the front entrance. In the isolation area, a bench is available for an ill child and the staff restroom adjacent to the front entrance is readily available if an ill child requires it. Age appropriate sinks and toilets were inspected for availability and good repair. General sanitation was observed. Availability of indoor drinking water was observed in each classroom (water jugs). LPA observed the office located on the second floor of the facility. LPA observed the stairs to be barricaded, making the stairs and second floor (office) off-limits to children in care.

Carbon monoxide detector and smoke detector were tested and are operable. The facility was granted a fire clearance for the requested capacity on November 16, 2022. The fire extinguishers are fully charged and were last serviced on July 29, 2022. Per applicants, the facility will not be providing transportation to children enrolled in care.

Disinfectants, cleaning solutions, and other items that are dangerous to children, were inaccessible to children in all areas. Applicants stated that there are no poisons stored at the facility. The kitchen/food preparation area and food storage areas are kept clean and are free of litter, rubbish, rodents, and/or any other vermin. All storage containers for solid waste have tight-fitting covers that are kept on and in good repair.

The facility has outdoor play equipment that is in a safe condition, free of sharp, lose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. All areas around or under high climbing equipment, and similar equipment are cushioned with material that could absorb a fall. LPA observed a large sand box located in the preschool play yard. Per applicants, the sand box will be inspected daily prior to use. There is adequate shade in the outdoor play yards. Availability of outdoor drinking water was observed (drinking fountain). There are no bodies of water on the premises.

During the inspection, LPA observed the toddler classroom did not have it's own access to the outdoor play yard. Based on observations, toddlers would need to walk through the preschool classroom to access their separately gated outdoor play yard. Per applicants, a waiver request and updated Daily Activity Schedule will be submitted to the Department by Friday, December 9th. Per applicants, if the waiver request is denied by the Department, the facility will install a separate door to the toddler classroom that would allow access to the outdoor play yard without the children walking through the preschool classroom. LPA advised the applicants that an updated Facility Sketch (LIC 999) would also need to be submitted to the Department to reflect any structural changes.

All individuals present have obtained a criminal record clearance or criminal record exemption. There is at least one person present with a valid Pediatric First Aid/CPR certification (EMSA-approved) during this inspection.

Applicants were reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

This facility plans to provide Incidental Medical Services – IMS. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. A Plan of Operation that includes IMS must be submitted to the Department. Items discussed during this inspection:
1. Licensing does not prohibit the following: Refused Entry to a Facility or Any Part of a Facility is a violation of Section 1596.852, 1596.853 or 1597.09. Regulations 101238 (g)(2), The Presence of an Excluded Individual, Fire Clearance Violations, Accessible Bodies of Water, Accessible Firearms, Ammunition or Both.
2. Menus are required to be posted one week in advance where it is visible by the child's authorized representative. Menus for the past 30 days must also be available upon request.
3. Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request.
4. At least one person trained in Pediatric First Aid and CPR must be present.
5. The name of the child care center Director or fully qualified teacher(s) designated to act in the Director's absence must be on file.
6. Educational background, training, and/or experience for each staff present must be available for review.

7. Children’s records must be available for review; including but not limited to, the following: Name, address and telephone number of the child's authorized representative and of relatives or others who can assume responsibility for the child if the authorized representative cannot be reached when necessary.
8. A person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles.
9. Records to be Maintained at the Facility - Child Care Centers (LIC 311A).
10. AB 1207: As of January 1, 2018, Health & Safety Code 1596.8662 requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. New employees shall have 90 days from date of employment to complete training as required. The training may be met by using the Department’s Office of Child Abuse Prevention (OCAP) online training modules at: http://www.mandatedreporterca.com/.
11. The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department.
12. Day care children need to be within the direct care and supervision, including visual supervision of staff at all times.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PINs), Program Quarterly Update Newsletters and other important information communication platform.

LPA provided assistance to the applicants on how to access forms, regulations and quarterly updates on the Child Care Licensing website at: www.ccld.ca.gov.

LPA also obtained a copy of the Child Care Program COVID-19 Self-Assessment and provided technical assistance on COVID-19 precautions.

Based on measurements taken during today's inspection, including sink (Preschool: 3 and Toddler: 4) and toilet (Preschool: 3 and Toddler: 3) availability, the facility is equipped for 44 preschool children and 21 toddlers (total capacity of 65). At this time, the maximum capacity would be the total capacity that was granted by the Fire Department.

Per applicants, the facility would like to request the increased capacity based on the measurements taken during today's inspection. Applicants will submit a revised Application (LIC 200A), revised Facility Sketch (LIC 999) for the Preschool and Toddler Component, and payment for the updated application fee (difference of $242.00) to the Monterey Park South West Child Care Regional Office by Friday, December 9th. LPA will submit an updated request to the Los Angeles County Fire Department (Whittier) to reflect the new requested capacity.

A final review of the application will be conducted by the Department. Once licensed, the licensee is required to adhere to the terms and limitations stated on the license.
