On April 25, 2023 at 8:30 AM, Licensing Program Analyst (LPA) Monique Ayala conducted an announced inspection at the facility noted above and met with Applicant, Sharoniece Swain. The purpose of the inspection was to conduct the required inspection for a pending application. Applicant is seeking to provide care for 25 infants. This facility consists of 2 classrooms: Room 1 and Room 2. The facility also has a separate room available that is solely used for napping and changing diapers. The operating hours for this facility would be Monday through Friday from 8:00 AM to 5:00 PM.

All areas identified on the facility sketch were inspected. LPA was guided on a tour of the inside and outside of the facility accompanied by Applicant, Sharoniece Swain.

Furniture and equipment were inspected for age appropriateness and good repair. Telephone service, heating, lighting and ventilation were evaluated. Infants have their own cubby in each classroom to store their belongings. Napping equipment (cribs and cots) were observed. Per Director, bedding will be washed daily at the facility. LPA observed a toilet and sink available inside Room 1, and a potty chair available inside Room 2. Inside the napping room, the facility has a changing table available with a sink that is within arms' reach. General sanitation was observed.

Per applicant, the isolation area is located in the front lobby. In the front lobby, a cot or moveable crib can be placed for an ill child and the staff restroom located near the kitchen is readily available if an ill child requires it. Availability of indoor drinking water was observed (water bottles). The facility also has a second floor that will be used for staff and parent meetings. LPA observed a child safety gate installed at the bottom of the stairs.

Smoke detector and carbon monoxide detector were not tested during this visit due to the detectors being wired to the emergency pull down system. The facility was granted a fire clearance for the requested capacity on March 23, 2023. The fire extinguishers are fully charged and were last serviced on August 17, 2022.

Disinfectants, cleaning solutions, and other items that are dangerous to children, were inaccessible to children in all areas. Applicant stated that there are no poisons stored at the facility. All kitchen areas/food preparation areas and food storage areas are kept clean and are free of litter, rubbish, rodents, and/or any other vermin. All storage containers for solid waste have tight-fitting covers that are kept on and in good repair.

The facility plans on providing lunch and snacks to the infants that will be prepared on-site. First Aid supplies were observed and are kept inside each classroom and in the hallway. Per applicant, medication is only administered to a child when accompanied with a doctor's note and medication will be stored in a locked box inside the kitchen.

Outdoor playground equipment is in a safe condition, free of sharp, lose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. LPA did not observe any high climbing equipment or slides in the outdoor play yard. There is adequate shade in the play yard. Availability of outdoor drinking water was observed (water pitchers).

Applicant was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. LPA discussed the safe sleep regulations with the applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Items discussed during this inspection:
1. Licensing does not prohibit the following: Refused Entry to a Facility or Any Part of a Facility is a violation of Section 1596.852, 1596.853 or 1597.09. Regulations 101238(g)(2), The Presence of an Excluded Individual, Fire Clearance Violations, Accessible Bodies of Water, Accessible Firearms, Ammunition or Both.
2. Menus are required to be posted one week in advance where it is visible by the child's authorized representative. Menus for the past 30 days must also be available upon request.
3. Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request.
4. At least one person trained in Pediatric First Aid and CPR must be present.
5. The name of the child care center Director or fully qualified teacher(s) designated to act in the Director's absence must be on file.
6. Educational background, training, and/or experience for each staff present must be available for review.
7. Children’s records must be available for review; including but not limited to, the following: Name, address and telephone number of the child's authorized representative and of relatives or others who can assume responsibility for the child if the authorized representative cannot be reached when necessary.
8. A person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles.
9. Records to be Maintained at the Facility: Child Care Centers (LIC 311A).

10. As of January 1, 2018, Health & Safety Code 1596.8662 requires all licensed providers, applicants, directors and employees are to complete training as specified on their mandated reporter duties and to renew their training every two years. New employees shall have 90 days from date of employment to complete training as required. The training may be met by using the Department’s Office of Child Abuse Prevention (OCAP) online training modules at: http://www.mandatedreporterca.com/.

LPA advised applicant that the infants need to be within the direct care and supervision, including visual supervision of staff at all times. LPA also advised the facility representative how to access forms, regulations, quarterly updates, and Provider Information Notices (PINs) on the Department website at: www.ccld.ca.gov.
Based on measurements taken today, the maximum capacity for the proposed program would be 11 infants. During the inspection, the applicant submitted a revised Application for Child Care Center License (LIC 200A) to reflect the new capacity.

A final review of the application will be conducted by the Department. Once licensed, the Licensee is required to adhere to the terms and limitations stated on the license.

Exit interview was conducted and report was reviewed with the applicant.
