32 | The Investigation revealed the following: Regarding allegation: “Client was sexually abused while in care.” This complaint alleged that the client was sexually abused by staff. On 04/28/2022 C1 was admitted to St. Mary Medical Center Long Beach. C1 presented to the emergency department today with suspected sexual abuse ongoing for the past eight months. C1 states that C1 was sexually abused at least three times a week. C1 states that C1 has been sexually assaulted at night. C1 denies any discharge, also expressed that C1 notified Long Beach Police Department today who came down and filed a police report, however no examination or testing was performed. On 06/21/2022 Investigator Kujawa interviewed C1 for complaint. C1 expressed that C1 did not disclose any specific incident regarding staff or clients that occurred at the facility pertaining to sexual abuse. C1 repeatedly mentioned that C1 is well taken care of at the facility and that the staff treat C1 well. On 06/21/2022 Investigator Kujawa interviewed W1 police officer for complaint. W1 expressed that W1 does not feel that the Sexual Assault Response Team (SART) needs to come out to examine C1. W1 has suspicion that this could possibly be psychological in etiology. W1 expressed that C1 can go back to Heritage Board & Care at any time. The assignment was not upgraded to a full investigation due to the lack of evidence found during my investigation. 2 out of 2 staff state to have no knowledge of any sexual assault on C1. C1 states that a unknown person came into C1 room and laid on top of C1 in C1 bed. C1 states that C1 went to the hospital for evaluation and hospital staff could not find anything wrong with C1. C1 states that the police did not write a report. C1 states that C1 feels safe living at the facility., 3 out of 4 clients state to feel safe living at the facility and 3 out of 4 clients have never been attacked by any other client or staff while living at the facility.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged allegation “Client was sexually abused while in care” did or did not occur, therefore the allegation is Unsubstantiated.
An exit interview was conducted with House Manager Danilo Garcia, and a hard copy was provided. |
