Licensing Program Analyst (LPA) Ana Soto conducted an initial complaint investigation for the allegations listed above. Today’s complaint investigation was conducted with Mary Cruz, Administrator

The investigation consisted of following: Interviews and Record reviews. On 05/08/23, LPA Soto interviewed S#1 - Administrator, S#2 - S#5, C#1 - C#5.LPA toured/inspected the kitchen, food storage, dining area, observed facility preparing lunch and clients having lunch. Facility served tuna sandwich, soup (tortilla), and fruit (orange slices) for lunch. LPA requested and received the following documents on 05/08/23:Client Roster, Staff Schedule, 4 Weekly menus for month of April 2023 and new menu began week of 05/08/2023.

Based on the LPA's investigation, the investigation revealed the following. Allegation 1 – Facility staff are not ensuring that residents are adequately fed while in care. Interviews conducted with S#1 - S#5, communicated that the facility serves a well balanced meals. They serve enough food for clients to get full. But, If the clients may still want seconds serving of food, the facility will give them seconds servings. The facility also provide alternatives, just in case clients do not want what's on the menu. They offer sandwiches, grilled cheese, fruit, PB&J sandwiches, hot dogs, and hamburgers as alternatives. Interviews conducted with C#1 - C#5, communicated that they are happy with the portions of food that they are served. If the want seconds servings, the facility gives them more. They have no complaints about the food. LPA observed cook preparing and serving the lunch meal for the clients. Lunch was a tuna sandwich, tortilla soup, orange slices, and juice. LPA observed a client that requested 2 sandwiches and the were served 2 sandwiches for lunch. The interviews and observations did not concur with the allegation above.

Allegation 2 - Facility staff are not ensuring that residents receive a variety of food while in care. Interviews conducted with S#1 - S#5, communicated that the facility serves a well balanced meals and a variety of options every week. The facility also provide alternatives, just in case clients do not want what's on the menu. They offer sandwiches, grilled cheese, fruit, PB&J sandwiches, hot dogs, and hamburgers as alternatives. S#1, also communicated that they are trying a new menu for the month May to see what the clients prefer to eat. Interviews conducted with C#1 - C#5, communicated that they are happy with the food that they serve. They have no complaints about the food. Every week they get something different it's no the same food every week. LPA reviewed the menu's for April and May 2023, April menu have a variety of food choices. They do not recycle their menus every week. May 's menu have a variety of food also. They will improve and change menu as they get feed back from the clients. The interviews, observations, and records did not concur with the allegation above.



Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated

An exit interview was conducted with Mary Cruz, Administrator, and a hard copy of report was provided.
