Licensing Program Analyst (LPA) Cynthia Chan conducted a complaint investigation regarding the allegations listed above. LPA arrived unannounced and met with administrator, Joyce Garcia. The purpose of the visit was explained.

The investigation consisted of the following:
LPA obtained copies of the staff and client rosters and interviewed Clients #1– 10 and Staff #1-8. During the visit, LPA toured the kitchen.

The investigation revealed the following:
Allegation - Staff did not ensure food provided to resident was free from contamination. It is alleged that staff served the client rice with moist brown stuff that smelled and always does “negative things” to the food. LPA interviewed kitchen staff, who denied this allegation.

Staff stated that they wear hairnets, gloves, and aprons when working in the kitchen. Foods are prepared safely and covered until they are served. Staff said they do not contaminate the food in any way. Staff have not heard of others complaining about finding items in the food, except from the same individual. LPA interviewed Clients #1 - #10. Nine (9) out of ten (10) stated that the facility staff added things to his/her food and had found metal pieces in the sandwich. The rest of the clients feel that the facility's food is either okay or they like it and have not found any objects in their food. LPA toured the kitchen today and observed staff serving the food to clients. There were no substances around the counters where the food is stored.

Staff do not ensure clients are spoken to in an appropriate manner. It is alleged that staff told Client #1 (C1) that if C1 keeps reporting the facility and filing complaints, they will call the cops to come and arrest C1. LPA interviewed the alleged staff, and the staff denied saying those words. Staff recalled the incident where the police came to interview C1 a few days ago. The law enforcement officer told C1 not to contact them unless it was a serious matter. The alleged staff reiterated to C1 what the police officer had said, but C1 would not listen and accused the staff of saying that the facility would call the police to arrest C1 if the client continued to file complaints against the facility. Other staff interviewed stated that C1 tends to twist their words around and would not allow them to explain things. Staff are aware that C1 is easily triggered by their words, so they keep the talks simple. Staff stated they received training on effective communication with the clients and are careful with the choice of words they use. LPA interviewed ten (10) clients, and nine (9) of them feel that staff are good and respectful. Clients have not been threatened or spoken to inappropriately by the facility staff.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are UNSUBSTANTIATED.



An exit interview was conducted with the administrator. A copy of this report, along with the appeal rights, was provided.
