Licensing Program Analyst (LPA) Alma Gonzalez conducted an unannounced complaint visit to gather information pertaining to the above-mentioned allegation. LPA met with Assistant Administrator Andrew De Vera and explained the reason for the visit.

The investigation consisted of: LPA conducted interviews with Assistant Administrator Andrew De Vera, Staff 1-5 (S1-5) and Clients 1-15 (C1-15). LPA collected copies of Staff and Client Rosters.

Investigation revealed the following: Regarding allegation, Staff make inappropriate comments towards resident, it is alleged that facility staff criticize clients and make inappropriate comments. Interviews conducted with facility staff revealed that facility staff do not make inappropriate comments or criticize any clients. Facility staff stated that if a client is acting inappropriately they will redirect the client in an appropriate manner.

14 out of 15 facility clients stated that facility staff do not make any inappropriate comments, do not criticize clients and stated that facility staff are respectful. During the time of the visit, LPA did not observe staff speaking inappropriately to clients. Based on statements gathered from interviews conducted with staff and clients there was not enough supportive evidence to concur with the reported allegation.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview held. A copy of the report was provided to Assistant Administrator Andrew De Vera.
