On 02/06/25 LPA Vaid conducted an Initial 10-Day complaint investigation regarding the above allegations. LPA was met by Joyce Garcia-Administrator. LPA discussed the purpose of the visit. LPA toured the facility with Administrator and did not observe any health and safety concerns. Investigation consisted of the following: interview of Staff #1 - Staff #6 (S1-S6); interviews of clients from client#1 through client #10 (C1-C10); requested, obtained, and reviewed client #1-10 (C1-C10) physicians report, and client personal property and valuables report. Staff roster and client roster.

Regarding allegation - Staff did not safeguard client's personal belongings. A client alleges another client has taken their belongings. It is further alleged that a client and client’s visitor took another clients belongings. The client reported the incident to staff; however, staff did not assist client.

LPA reviewed client #1’s (C1) Personal Property and Valuables form and did not see any personal items listed on the form. The items that were allegedly stolen were not listed on the C1’s personal property form. Six (6) out of six (6) staff interviewed deny the allegation. Eleven (11) out of eleven (11) clients interviewed could not corroborate the allegation. C1 stated that C1’s personal items are missing. Client #2 (C2) denies this allegation and reported C2 has never taken items from anyone. According to staff, the facility issues storage cabinets with a lock and key to all clients to safeguard their belongings. According to the staff, C1 did not inform the facility staff of the items they purchased. Interview with housekeeping staff revealed there have been no changes in C1s room. According to housekeeper and Administrator, C1’s personal property has not been changed out or replaced. Housekeeper does not know if any items were taken out of C1's room. The client room keys are issued to each person residing in the room and keys remain with clients. Staff keeps extra room keys for emergencies and housekeeping when staff need to enter clients’ room to clean or ensure clients safety. Although the allegation(s) may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

Regarding the allegation that "Staff are not treating clients with dignity and respect," it is alleged that a staff had gotten upset with a client while the client was bringing up concerns they had with the staff, and the staff had subsequently yelled at the client and staff waved their hand in the client’s face. During interviews with clients twelve (12) out of fourteen (14) clients did not corroborate the allegation. One of the clients interviewed stated that they believe the staff treat them and all other clients in the facility with dignity and respect. Another client interviewed stated that both S1 and S2 are kind people and client has never had any conflicts with S1 or S2 or any of the facility staff. During interviews with staff, five (5) out of five (5) staff did not corroborate the allegation. One of the staff interviewed stated S1 and S2 had never yelled at the clients. Administrator reported C1 wanted to discuss C1 concerns with Administrator, however Administrator was not available and informed C1 that C1s concerns will be addressed and C1 became upset. Staff 5 (S5) was present when C1 became upset and spoke with C1 about Administrator addressing C1’s concerns at a later time. S5 reported staff did not yell at C1 and C1 was treated respectfully. Although the allegation(s) may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

Regarding the allegation that a "Client is threatening another client due to lack of supervision," it is alleged that a client had a weapon in the facility and staff did not investigate to confirm if a client had a weapon. During interviews with the clients, eleven (11) out of fourteen (14) clients interviewed did not corroborate the allegation. One of the clients interviewed stated that there are times where clients fight amongst each other however staff are generally on top of things when threats and fights arise. Another client interviewed stated that they have never witnessed clients threatening one another in the facility. During interviews with staff, five (5) out of five (5) staff interviewed did not corroborate the allegation. Staff had no knowledge that a client had a weapon in the facility or was threatening other clients. One of the staff interviewed recalled an incident that occurred about 2 years ago, however, the staff did not recall a recent incident. Another staff interviewed stated that local law enforcement has not come to the facility recently in response to threats being made. Although the allegation(s) may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.


Exit interview was conducted with Administrator Joyce Garcia. A copy of the report was issued.
