Licensing Program Analyst (LPA) Cynthia Chan conducted a complaint investigation on the allegations listed above. LPA arrived unannounced and met with Assistant Administrator, Andrew De Vera. The purpose of the visit was explained.

The investigation consisted of the following:
LPA toured the facility and obtained a copy of the staff and client rosters. LPA interviewed the Assistant Administrator, 4 Staff, and 14 clients.

The investigation revealed the following:
Regarding allegation - Staff is not ensuring a safe and comfortable environment by increasing the facility speaker volume when communicating to clients. According to the Assistant Administrator, the speaker volume is adjustable, but they keep it below level 5. He stated that they do not lower the volume below 1 otherwise, they will not be able to hear the announcements.

If turned higher than 5, then it’ll be too loud. Staff interviewed stated they are ensuring a safe and comfortable environment by keeping the facility speaker volume at a level not too loud or soft. 4 out of 14 clients interviewed today stated that the facility speakers can be loud at times which hurt their ears. The other clients did not have any issues with the speaker volume. During the visit today, LPA had facility test their speakers at different location throughout the facility and the volume appears to be at a tolerable level.

Regarding allegation - Staff intimidating a client in care. It is alleged that a staff ran up to client’s face to ask about his/her business. Based on interviews conducted with staff, all the staff denied approaching clients in such manner. They keep their distance from clients and do not get into their business. If a client wants to share some information with staff, staff will ask if they would like to speak in private. Staff interviewed have not seen other staff approach clients in a rude or threatening way. LPA interviewed 14 clients and 2 of them felt intimidated by staff. They did not like that the staff tried to inquire about their personal business. The rest of the clients interviewed did not have any issues with staff and felt they are respectful.

Regarding allegation - Staff spoke inappropriately to a client in care. Based on staff interviews, they stated they treat clients with respect. They do not speak inappropriately to clients nor do they yell at them. Some staff said that they are firm with the clients which could be misconstrued. They have not witnessed any staff speaking improperly to others. 13 out of 14 clients interviewed stated that the staff are respectful and have not spoken to them inappropriately. They also have not seen staff speaking inappropriately to others.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.



An exit interview was conducted with the Assistant Administrator. A copy of this report along with the appeal rights were provided.
