Licensing Program Analyst (LPA) Christine Wong conducted a unannounced subsequent complaint visit to investigate the above the allegations. LPA met with Administrator MAGPAY, PRECIOSA (SUZIE) and she assisted LPA with the visit today.

The investigation consisted of the following: LPA conducted an initial 10 days complaint visit on 1/12/22 and interviewed the administrator and LVN and obtained the staff rosters including the contact information and work schedule and residents rosters. On today's visit, LPA interviewed twelve (12) residents (R1-R12) and six (6) staff (S1-S6) and obtained copy of staff in service training information and reviewed (R1-R4) Medication Administration Record (MARs).

The investigation revelaed of the following: Allegation#1 "Staff are mismanaging resident's medication." LPA interviewed twelve (12) residents and eleven (11) residents denied the allegation.

All eleven (11) residents reported staff never missed their medication or mismanaged their medication. They always received their medication on time and staff would also ensure the residents to swallow the medication before leaving their rooms. Staff also reported they always follow doctor's order or family members on residents' medication. They would ensure each medication was prescribed by the doctor and with doctor's signature. They would never gave medication to residents without doctor's order.

Allegation#2 "Staff are not adequately trained." LPA interviewed twelve (12) residents and eleven (11) residents reported all staff are well trained and staff are able to meet their needs. All staff are very caring and they take care of them very well without any issues or complaints. Residents expressed for those new staff, they are willing to learn, respectful and sweet. Staff reported they all required to receive hours of training each year. Administrator reported the new hire, they would have to complete one week video training provided by the company and many weeks of shadowing with the co-workers until they are ready. For the regular staff, each year they are required to have certain hours of training with different topics about the residents needs and care.

Allegation#3 "Facility has inadequate staffing." LPA interviewed twelve (12) residents and seven (7) residents denied the allegation and reported the facility has adequate staff and they are able to get the assistance or help whenever they need from the staff. The facility are fully staffed. Staff reported the facility is not under staffing. Staff stated they were fully staffed even during the outbreak of COVID-19. They may have one or two staff called out but they were able to work together and had a full team during the pandemic/lock down. No staff ever got overwhelmed due to staff shortages or no residents ever complained they were short staffed.

Based on statements and interviews conducted as well as LPA observation and record review, there was not enough supportive evidence to concur with the reported allegations. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are UNSUBSTANTIATED.
