32 | Per administrator Binotapa, she was working with S1 on the day of the alleged incident. Administrator stated there was an altercation between C1 and another client. Staff had to separate the 2 clients to prevent the situation from escalating. Administrator took one client and S1 took the other client to calm them down. Administrator witnessed S1 in the room with the door opened, trying to redirect C1. She did not see any signs of abuse from S1 nor did C1 reported any maltreatment. Administrator stated that she was informed of Staff hitting and pulling the client’s hair the next day. The police officer also came out the same day. She stated the officer spoke with clients at the home and indicated there is no case and is closed.
LPA interviewed 4 other staff and they all stated they would not hit or hurt a client. They understand their clients’ behaviors and only redirect them when necessary. Staff have not observed any bruises or marks on C1. They are mandated reporters and stated they would report if they saw any staff hit a client. They also have never seen any staff pull a client’s hair. Staff indicated that C1 tends to make false statements or fabricate stories.
LPA interviewed 5 Clients. Clients stated staff are good to them. They do not hit them nor pull their hair. C1 disclosed that a lie was made about S1 hitting C1 and pulling the hair earlier this week and was apologetic. C1 was upset because other clients are being mean to C1. Records reviewed showed that C1 is working on reducing the number of false statements or false accusations of people and was confirmed by the regional center service coordinator.
Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
An exit interview was conducted with Administrator Binotapa. A copy of this report along with the appeal rights were provided.
