On 09/13/2022 Licensing Program Analyst (LPA) Troy Agard conducted a subsequent complaint investigation to deliver findings for the allegation listed above. LPA met with Joyce Garcia, Facility Manager and the purpose of the visit was explained.

The investigation consisted of the following: On 09/01/2022 LPA Agard conducted a tour of the facility grounds. The facility is a two-story building including 37 client rooms, office, kitchen, dining room, laundry room, and outside patio areas. The facility is licensed for a capacity of 72. LPA interviewed staff, residents, and reviewed records. LPA Agard requested the following documents, which were received at the time of visit: 1) a copy of the staff roster, 2) a copy of the resident roster, 3) A menu for the month of August and 4) C1’s file. An additional interview was conducted on 09/13/2022.

The investigation revealed the following: Regarding the allegation: Resident(s) uses illegal substance in facility. It’s being alleged that residents are using drugs in the facility and staff are allowing it. LPA interviewed 4 out of 16 staff in total. 4 out of 4 confirmed the allegation. S1 states, “there are residents here that are using illegal substances. I’ve made LIC forms about those as well and tried to evict some residents, but licensing said that these are not reasons for evictions.” S2 states, “yes the clients use drugs. I’m not sure what kind but they use. There are many people that sell on the street especially on Wednesday. There are people that sleep in the alley that sell drugs. Every Wednesday there is a white van that comes and parks in front. There are guys on bikes. I’ve seen lots of residents in here on drugs.” S3 states, “I only heard about weed because I can smell it. We have found a pipe. So maybe they are doing meth and hiding inside their room.” S4 states, “that’s true! All I can do is try to control it. They buy it off the street. If it gets bad, then they do get a 30-day notice. However, Licensing doesn’t like to put out people anymore for things like that.”

During interviews with residents, LPA interviewed 6 out of 60 residents. 1 out of 6 confirmed the allegation. 5 denied the allegation. C6 states, “they use drugs here. It varies from marijuana to methamphetamine. Besides C1 I can’t think of anyone else. C1 states, “no, haven’t seen anyone using drugs here. I’m not using drugs.” C2 states, “I’ve observed my roommate using marijuana, but I have not observed any other drugs. C3 states, “No, I have not observed anyone using drugs here. C5 states, “no, haven’t observed anyone using drugs. Weed, yes but meth, no. Just weed.”



Based on the interviews conducted. The “preponderance of the evidence” standard has been met; therefore, this allegation is substantiated. Title 22 Division 6 Chapter 8 Article 8 is being cited please see LIC9099D.

The investigation revealed the following: Regarding the allegation: Staff does not meet resident’s dietary needs. It’s being alleged the facility does not offer vegetables or fruits. LPA interviewed 4 out of 16 staff in total. 4 out of 4 denied the allegation. S1 states, “we don’t have any residents on a super special diet. Any time we get a referral and there are a bunch of dietary restrictions we reject them because they may need a higher level of care that we can’t provide. If they have a lot of restrictions, and we cannot comply, I usually don’t take them. Those that say they don’t eat meat like pork and beef, we take them because we can give them alternatives like fish or vegetarian. We have a few sugar free items like syrup and other items. We also serve fruits and veggies.” S2 states, “we have sugar free sugar and sugar free syrup. I serve veggies and fruits for lunch or dinner. I serve watermelon, pineapple, salads, it just depends.” S3 states, “we try to make sure all clients meals are balanced. We serve fruits and veggies. Fruit salads or salads during lunch and veggies during dinner.”

During interviews with residents, LPA interviewed 6 out of 60 residents. 6 out of 6 denied the allegation. C2 states, “they do serve fruits and veggies at lunch and dinner time. They serve pineapple, watermelon, corn, green beans, carrots.” C3 states, “my diet needs are met. At lunch they usually serve soups. The food is alright, they serve a variety of fruits and vegetables.” C5 states, “the food is good. For our meals they give apples, bananas, oranges. Sometimes they mix it up or you can have it as a snack after lunch.” C6 states, “they give a full balance meal. Fruits and veggies and protein. It all depends on what we are having. Sometimes we get stew or vegetable soups but yes fruits and veggies are served.”

Regarding the allegation: Staff does not provide resident water. It’s being alleged that no water is provided. 4 out of 4 staff denied the allegation. S1 states, “the residents always have access to fresh water. Especially during summer months, we put out a big jug of water. That water is available 24/7. They also have access to the water fountain. We have smaller jugs of water bottles upon request. We just asked that they bring back the jug.” S2 states, “the clients have access to water. It’s in that jug there. I keep it filled all day with ice water. They also have a water fountain and small jugs of water here.” S3 states, “we have the fountain here. We have the water in the jug that we refill all day, like continuously. Water is there. Anytime they come to the window for medication, we give them water. We never deprive them of water. Especially during this season. We try to push them to drink.”

During interviews with residents, 6 out of 6 denied the allegation. C1 states, “we have access to water on the first floor.” C2 states, “yes, we do have water. There is a jug right here and it has cold water in it.” C4 states, “yes, that’s what I’m drinking now.” C6 states, “there is a tap down here that we can put our bottle to and get water. If we wanted cold water, there is an arrowhead bottle machine that they let us use or is used to give us cold water. “

During a record review, LPA reviewed the following records: a staff roster dated 08/15/2022. All staff interviewed matches with roster. A resident roster not dated. All residents interviewed matches with the roster. During the tour of the facility, LPA observed a 5-gallon heavy duty water cooler accessible to the residents. LPA also observed a surplus of perishables and non-perishables in facility kitchen and pantry. LPA observed meal preparation that was consistent with the menu for the week and additional food options such as chicken teriyaki, salad and French fries.

Based on LPA’s observation, interviews conducted, and record review, the preponderance of evidence standard has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
