Licensing Program Analyst (LPA) Cynthia Chan conducted a subsequent complaint visit to deliver findings for the allegations listed above. LPA met with Staff, Marc Marquez, and provided the reason for the visit.

The investigation consisted of the following:
On 6/16/23, LPA Chan toured the facility with staff and requested documents pertaining to Client #1 and staff training logs. There were no clients at home during the time of the visit. The facility had sufficient food supplies of 2-day perishables and a week of non-perishables. Knives and cleaning products were locked and inaccessible to clients. LPA did not observe any immediate health and safety concerns. LPA held interviews with the administrator, Staff, and Clients on other days.

The investigation revealed the following:

For allegation – Facility staff sexually abused client. The Department of Social Services Investigation Branch Investigator Dennis Douglas conducted interviews with the Client and Staff members of the facility for this allegation. Per the interview with Client #1 (C-1), C-1 admitted to falsifying the claim due to being upset about something unrelated to the allegation. The alleged Staff was also interviewed and denied engaging in any inappropriate sexual behavior with the client. During the investigation, it was also revealed that C-1 made a similar false claim in the past, of a sexually assault by another staff member in which C-1 recanted the claim. LPA Chan obtained a copy of the San Gabriel/Pomona Regional Center Findings for this recent incident. It was determined to be unsubstantiated due to C-1 reported of lying about the sexual assault.

For allegation – Facility staff spoke inappropriately to client. LPA Chan interviewed the administrator and 7 Staff regarding this allegation. Staff denied speaking inappropriately to clients and have not witnessed any staff yelling at them. They stated they need to be firm with the client at times. If a client has a behavior, they allow them time to calm down. If a client does not comply, they would ask another staff to intervene. However, they would not yell at clients to get them to do things. Per staff, they are trained to be respectful and professional. All the staff employed are either Registered Behavioral Technicians or Direct Support Professionals equipped with CPI training. One of the clients interviewed stated staff are nice and do not yell at them.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.



An exit interview was conducted with Staff Marquez. A copy of this report along with the appeal rights were provided.
