32 | INVESTIGATION REVEALED THE FOLLOWING:
Allegation: Illegal Eviction.
It alleged that Resident #1 (R1) was served with an Illegal Eviction. Reports indicated that (R1) was served with a 30-Day Eviction on August 11, 2026. No further details regarding this matter.
On September 14, 2026, between 9:30 AM and 10 AM, the Department interviewed Executive Director identified as (ED). The Executive Director (ED) confirmed that on August 11, 2026, Regency Palms issued a formal 30-Day Notice to Terminate Resident #1 (R1). This notice outlines the procedure for notifying residents in writing and ensures all official communications are properly delivered. It states the grounds for the eviction and the reasons for this decision. Furthermore, the document indicates the importance of conducting the relocation process in accordance with established regulatory standards to ensure that all legal requirements are fulfilled. The notice states that (R1) must move from or surrender the premises from the community by September 11, 2026, which is the termination date.
On September 14, 2026, at 11:55 AM and 12:20 PM the Department interviewed Resident member identified as Resident #1 (R1). (R1) confirmed receipt of the 30-Day Notice to Terminate on August 11, 2026. (R1) disputes the reason for the decision, stating that the facility cannot meet the dietary recommendations and requirements. (R1) mentioned to have submitted an Appeal in response to the Notice on August 27, 2026.
The Department reviewed the 30-Day Notice to Terminate (dated 08/11/26) and confirmed it complies with Title 22, Section 87244-Eviction Procedures; it outlines the requirements for notifying a resident in writing, serving proper Notice, stating reasons for eviction, and ensuring relocation is conducted in accordance with regulatory requirements. Further review of (R1’s) Physicians Report LIC602A (dated 05/09/24) Service Plan (dated 07/24/25), Resident Assessment (dated 09/11/26 & 06/23/26), DHCS Individual Service Plan (dated 06/26/24), and Facility Notes & Incidents (dated 07/02/25 & 07/22/26) all reports dd not list (R1) “required special diets”. Further review of several physician medical notes (dated 08/21/26, 01/27/26, 08/04/26 & 10/03/25) indicates to only provide recommendations and advised seeking guidance from a nutritionist or dietitian - nowhere it indicates (R1) is on "special diet".
The California Department of Social Services complaint #11-AS-20260730100723 has addressed (R1's) dietary restrictions which determined that the allegation was unsubstantiated.
Interviews with the Executive Director (ED) and the resident (R1) indicated that the facility adhered to established procedures and involved the resident in the discharge process.
