Licensing Program Analyst (LPA) Nicol Wesley initiated a subsequent complaint investigation for the allegations listed above and met with Administrator Mona Castro.

The investigation consisted of the following: On 04/08/21 LPA Wesley conducted a telephonic interview with Administrator Mona Castro and requested the following documents: staff roster, resident roster, current admission agreement for resident #1, ID page for resident #1, physicians report for resident #1, appraisal needs and services for resident #1, and any eviction notices issued to residents in the 2021 year be emailed/faxed to Nicol Wesley by 04/09/21.

Regarding allegation: Resident is being unlawfully evicted. LPA interviewed Administrator Mona Castro who in informed me of her concerns with the residents who formed a group called next door which is a Neighborhood watch group for residents in the area. The Administrator advised that was not able to participate in the

group due to a past situation that involved resident #1. Administrator Mona Castro Change of Ownership(CHOW) is the currently facility operator effective 12/08/2018 and resident #1 has resided in the facility prior to the change of ownership. The Administrator advised that she was approached by two neighbors who confronted her and expressed their concern and stated that they did not wish for resident #1 to reside in her licensed facility and the Administrator said she was quite embarrassed. Administrator Castro informed the LPA that resident #1 was never served an eviction notice. LPA Wesley informed the Administrator that resident #1 has lived in the facility for over 8 years and has been compliant without violating any Title 22 regulations. During the interviews with other parties, LPA was informed that the Licensee/Administrator began verbally advising resident #1 to move out and find other placement. It was communicated that this mistreatment did not occur until the new facility operators took over. The Administrator informed LPA Wesley that she did not give resident #1 a formal eviction notice. LPA Wesley informed the Administrator that she can not request for the resident to vacate as there were no documentation or any violation of the facility house rules or violation of title 22 regulations. LPA Wesley interviewed resident #1 who said they are not being evicted and they have not received an eviction notice. There is no sufficient evidence to support the allegation: Resident is being unlawfully evicted.

Regarding allegation: The Administrator forces the resident to open U.S. mail in their presence. LPA interviewed Administrator Mona Castro who advised that they do not open resident #1's mail and that resident #1 ask for their assistance to read the letters as they are unable to read or comprehend what the letter says. LPA Wesley interviewed resident #1 who said the Administrator does not read their mail and denied that their mail was opened. There is no sufficient evidence to support the allegation.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is Unsubstantiated.
