Licensing Program Analyst (LPA) Jose Villalobos conducted an unannounced complaint investigation visit for the allegation(s) listed above. LPA met with Administrator Diane Perez and the purpose of the visit was discussed.

LPA conducted the following: LPA toured the physical plant of the facility, Interviewed clients #1-#3 , interviewed Staff #1-$#4 , reviewed staff files related to the allegations, reviewed client files related to the allegation, and collected copies of the staff and client roster. The investigation revealed the following:

In regards to the allegation "Staff does not ensure services are being provided to clients in care" it is alleged that staff are denying services to clients. LPA was not provided with further information regarding the services being denied. (4) of (4) Staff interviewed denied the allegation. (4) of (4) Clients interviewed denied the allegation...

LPA observed a 1-to-1 staff/client ratio. Staff interviewed were able to state the assistance and services they provide the clients in care. Clients did not state there to be any issues with the services they receive. Based on interviews, file review, and observation conducted; although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

In regards to the allegation "Staff does not ensure facility is in good repair" it is alleged that facility maintenance is not being done. LPA was not provided with further information regarding which maintenance services are not being done. (4) of (4) Staff interviewed denied the allegation. (4) of (4) Clients interviewed denied the allegation. LPA toured the physical plant and did not observe the facility to be in disrepair or have any issues with the utilities. Staff interviewed stated there are no issues with maintenance of any equipment, furniture, or physical plant of the facility. Clients interviewed were not aware of any issues with maintenance in the facility. Based on interviews, file review, and observation conducted; although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

In regards to the allegation "Staff are not qualified to provide care and supervision" it is alleged that staff are unqualified to provide care to the clients. LPA was not provided with further information regarding the allegation. (4) of (4) Staff interviewed denied the allegation. (4) of (4) Clients interviewed denied the allegation. LPA reviewed a sample of six (6) staff files in the facility. Staff files were observed to have training needed to meet Title 22 regulations on personnel qualifications and duties. First Aid, CPR, and CPI training's were observed in staff files. LPA also observed the facility to meet 1-to-1 staff/client ratios during the visit. Based on interviews, file review, and observation conducted; although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
