32 | Five (5) out of five (5) staff interviewed deny this allegation. Staff stated the residents are to provide staff with the list of valuables the residents bring to the facility and the personal belonging list is kept in the residents’ facility files. Residents’ declined to provide personal property and valuables list. According to the investigation, the staff is encourages residents to safeguard their belongings, residents are provided a room key and are encouraged to lock room before leaving, even momentarily. Residents are encouraged to leave valuables with the staff if residents can not safeguard their valuables. Residents have access to lock box in residents’ closets. Staff gives residents a tour of their rooms and residents are shown where residents can lock up their valuables. Eight (8) out of ten (10) residents interviewed could not corroborate this allegation. Residents stated that they are aware of other residents are taking residents belongings but have not seen it. According to three (3) previous resident roommates of R2 interviewed were unable to corroborate the allegations of theft by R2. R2 denied taking anything from R1. According to R2’s physician report dated 3/11/25, R2 is not able to transfer from bed to wheelchair without assistance due to R2’s health conditions. LPA Vaid observed a partition between R1 and R2 personal space. LPA Vaid did not observe any medications left behind by the staff. Physicians’ reports for both residents state R1 and R2 unable to administer own prescriptions. R2 denied taking R1’s money, denied filming R1. LPA Vaid observed from the position R2 was laying down, only the front wall is visible from R2’s view to R1’s side of the room. Based upon record review and interviews conducted and observations made the findings indicate that, although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
Regarding the allegation: Staff did not prevent resident from engaging in inappropriate behaviors. It is alleged that the staff did not prevent residents from acting out and displaying behaviors determined inappropriate like stealing residents’ property and engaging in theft of other residents’ property. Five (5) out of five (5) staff interviewed stated that when residents engage in appropriate behaviors the staff will assist the residents to resolve their issues. According to the staff when residents argue and yell at one another, the staff quickly intervenes and separates the residents, calms down the residents and attempt to resolve misunderstandings residents encounter with one another. Staff will assist residents to find their lost/ misplaced items. Law enforcement is called when issues get out of control and resident is unable to control their anger and behaviors. Nine (9) out of ten (10) residents interviewed were not able to corroborate this allegation. Residents have heard other residents verbally fighting and yelling but have not witnessed it. Six (6) out of ten (10) residents interviewed stated that they encounter residents that display strange behaviors like yelling, screaming, making strange faces but have not observed residents stealing others property. Based upon record review and interviews conducted the findings indicate that, although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
