Licensing Program Analyst (LPA) Sanjay Vaid conducted the initial 10-day complaint. LPA Vaid met with Administrator Gil Agas and discussed the purpose of the visit. LAP Vaid toured the facility with Administrator Gill and did not observe any health and safety concerns.

The investigation consists of the following: LPA Vaid requested, obtained and reviewed; staff roster, resident roster, the admissions agreement, house rules, eight (8) residents’ face sheet and ID, physicians reports. LPA observed the water pressure and recorded the temperature readings for ten (10) residents’ rooms.

Regarding the allegation: Staff do not prevent residents from smoking in their rooms. It is alleged that the staff is preventing residents from smoking in their rooms. Six (6) out of Six (6) staff interviewed deny this.

When a resident is observed by staff for smoking indoors or their rooms the manager is quick to investigate, the residents are reminded of the house rules and violation notice is given to the resident and communicated to their POA. According to the staff, residents that violate the house rules for similar issues are reminded constantly, staff has posted ‘No Smoking” signs near and in suspected smokers’ rooms to remind residents of the no smoking rule. LPA observed ‘NO Smoking’ signs posted throughout the facility, hallways and in suspected smoker’s rooms. Seven (7) out of Eight (8) residents interviewed could not corroborate the allegation. A few residents interviewed state they have smelled cigarette and marijuana smoke around the facility but not seen anyone smoking indoors. Based upon interviews and observations conducted the findings indicate that, although the allegation(s) may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.

Regarding the allegation: Staff do not ensure water temperatures are properly maintained throughout the facility. It is alleged that the facility is not ensuring the water temperature is properly maintained throughout the facility. Six (6) out of Six (6) staff interviewed deny this. Interviews with staff indicate that in the part the facility had issues with the water broiler earlier this year, the issue was resolved with a new water heater replacement, January 2025. LPA Vaid measured the hot water temperature in ten (10) residents’ rooms by holding thermometer under the hot water for 60 seconds and the temperature readings measured between 105-120 deg F. Seven (7) out of eight (8) residents interviewed could not corroborate the allegation, six residents interviewed stated they have never had issues with the hot water temperature. Based upon interviews and observations conducted and water temperature measured the findings indicate that, although the allegation(s) may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.

Regarding the allegation: Staff do not ensure facility has adequate water pressure for residents’ use. It is alleged that the facility is not ensuring adequate water pressure for the residents and at times is the water pressure is very low. Six (6) out of six (6) staff interviewed deny this allegation, the water pressure is normal throughout the facility all the time. Caregivers assisting residents with showers confirm that the water pressure is normal. LPA Vaid observed the water pressure in ten (10) residents rooms, each room the hot water was measured, the pressure was observed to be a steady stream, and the water is flowing with constant speed out the taps. Seven (7) out of eight (8) residents interviewed could not corroborate this allegation, residents interviewed stated they have no concerns about the water pressure and able to take showers without issues. Based upon interviews and observations conducted and water temperature measured the findings indicate that, although the allegation(s) may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.

Regarding the allegation: Staff do not ensure facility is free of mal odor. It is alleged that the staff do not ensure facility is free of mal odor. The smell of the smoking was observed by LPA Vaid in the smoking patio area and the rear gate, LPA Vaid conducted a visual and smell check of the hallways and did not notice mal odor in the facility. Six (6) out of six (6) staff interviewed deny this allegation. The staff is cleaning and sanitizing the hallways and commons areas constantly. Housekeeping cleans residents rooms daily. Seven (7) out of eight (8) residents interviewed could not corroborate the allegation. Four rooms checked during LPA observations revealed body odor from residents not wanting to bathe and the odor was contained to the residents’ room and odor was not observed in the hallways. Six (6) out of eight (8) residents interviewed stated that some residents who do not shower regularly carry a foul body odor upon them. They have heard the staff constantly remind residents to shower on their assigned days. Based upon interviews and observations conducted and water temperature measured the findings indicate that, although the allegation(s) may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.

An exit interview was held and copy of this report was given to Administrator Gil Agas.
