On 02/27/2026, Licensing Program Analyst (LPA) Valerie Mireles conducted an unannounced complaint inspection. LPA met with Director Marcela Esparza. The purpose of the inspection was to deliver the findings for the above complaint allegation.

This agency investigated the complaint alleging, “Staff did not report incident to daycare child's responsible party in a timely manner.” During the course of the investigation, LPA interviewed the Director, day care staff, and day care parents. LPA also attempted to review documentation pertinent to the investigation. LPA interviewed the Director, who reported that an incident occurred, on or around 05/2025, where a child choked on a cookie and staff performed the Heimlich Maneuver, which was corroborated with daycare staff. The facility notified the parent of the child verbally the following day, at the end of the day, and did not report the incident to Community Care Licensing, as required. There was no documentation regarding the incident available. Continued to LIC9099-C

Although the facility staff took appropriate measures to address the child choking, they failed to notify the child’s responsible party in a timely manner, which violates CCR101226.3(b). Children need to be in a safe, healthful, and comfortable environment. This poses a potential health and safety risk to children in care.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, this deficiency is cited on the attached LIC 9099D. An exit interview conducted with Director Marcela Esparza. A copy of this report and Appeal Rights were provided and discussed. A Notice of Site Visit Form was posted to parent's board and must remain posted for 30 days.

This agency investigated the complaint alleging, “Unqualified staff providing care and supervision,” and “Day care child sustained an injury due to staff neglect.” During the course of the investigation, LPA reviewed documents pertinent to the investigation, interviewed the Director, day care staff, and day care parents.

LPA observed children in care to be supervised by a Teacher or Teacher and at least one Teacher Aide, within ratio and staff to be attentive to the needs of the children. Interviews and the information obtained did not corroborate allegations.

Although a child was injured while in care, LPA was unable to gather sufficient evidence to determine that the injury was sustained due to neglect. Additionally, based on record review, all staff present at the day care is eligible as a Teacher or Teacher Aide working directly with a Teacher. Per CCR 101216.2(e)(1), an aide who is 18 years of age or older… may escort and/or assist children in going to the bathroom and may supervise napping children as specified in Section 101230(c)(1), without being under the direct supervision of a teacher.

Although these allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations; therefore, the allegations are UNSUBSTANTIATED.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, no deficiencies are cited. Exit interview conducted with the Director Marcela Esparza. Appeal rights were provided and discussed. A Notice of Site Visit was given and will be posted for 30 days.
