On 02/06/24 Licensing Program Analyst (LPA) Denisia Jimenez conducted an unannounced Required inspection and met with Licensee, Mayra McDonald. Also, present was the licensee’s husband/assistant. LPA took a census and there were 8 children and 1 infant in care. The licensee operates as a small childcare home with a capacity of 8. Licensee was over capacity and out of ratio. One of the daycare children was picked up five minutes after LPAs arrival, putting Licensee back in compliance. The Licensee is in violation of the regulation code 102416.5(a). LPA will issue two Type A citations.

LPA confirmed with licensee hours of operation are Monday through Friday 8:00 AM to 5:00 PM and other hours as arranged. LPA also confirmed the family childcare home has a working telephone service, and Licensee confirmed the phone number is 559-664-1434.

LPA and licensee began the tour of the home inside and outside. The current facility sketch reviewed, and Licensee confirmed that the kitchen, dining area, living room, den, and hallway bathroom are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible using a safety lock.

There is a built-in swimming pool in the backyard which is fenced and made inaccessible. The pool gate is self-latching, self-closing and opens away from the swimming pool. No windows or doors have direct access to the pool area. The licensee stated she built her pool in November 2023. Licensee stated there are no firearms or ammunition on the premises. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible.

There is one fireplace in the home located in the living room and is made inaccessible by a glass door and will not be in use during day care hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There are no stairs in this home. Safe toys and play equipment were observed. Adequate supervision was being provided during this inspection.

The outdoor play area in the backyard is fenced and there are no hazards to day care children. Licensee ensures that children in care are supervised at all times. The licensee has 2 dogs and only one is accessible to children. The other dog is outside in the backyard behind a fence around the side of the house. The licensee is aware of child safety around pets and accepts responsibility for any action taken by pets. The licensee is aware children shall not be left in parked vehicles and is aware car seats are used for transportation purposes only and are not used for sleeping children.

There is currently 1 infant in care. There is one crib or play yard for each infant in care, cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. The provider physically checks on sleeping infants every fifteen minutes and documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness, and labored breathing. Infants can be visually observed through an open door if sleeping in a separate room. The Individual Infant Sleeping Plan has not been completed and is not in file for each infant up to 12 months of age. LPA explained to the licensee the importance of having all required documents in children’s records for review. Licensee understood. LPA will issue a Type B citation. Infants up to 12 months of age are placed on their backs for sleeping.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The licensee has a current roster of children. A sample of children’s records contained all emergency information specified by regulation. An emergency fire/disaster drill has been completed and documented within the last 6 months. Licensee’s Mandated Reporter Training was completed on 02/19/23. Licensee’s pediatric CPR/First Aid expires on 11/2025. A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis, but couldn't provide proof of measles. Licensee will provide LPA with a copy of measles for her assistant.

All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

The licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

To improve the quality and value of the new inspection process, a survey may be sent to the email address provided. Please complete the survey and share your inspection experience. Exit interview conducted and report was reviewed with licensee, Mayra McDonald. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA verified the RSO profile in FAS.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page).

Licensee was provided appeal rights.

Upon receipt of a Type A violation, the licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Licensee.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
