25 | On 05/24/2024, Licensing Program Manager (LPM) Juvenal Moctezuma and Licensing Program Analyst (LPA) Jeovanna Yanez met with Licensee, Mayra McDonald, for an Informal Meeting at the Fresno Regional Child Care Office. The purpose of today’s Informal Meeting was to discuss previous deficiencies cited during past inspections that were conducted on 06/28/2019, 02/04/2024, and 05/02/2024. LPM Moctezuma reviewed the deficiencies with Licensee and how the Family Child Care Home will maintain compliance with the deficiencies cited below.
The Department of Social Services, Community Care Licensing Division has determined that Mayra McDonald Family Day Care Home violated the following Title 22 licensing regulations:
On 05/02/2024, LPA Jeovanna Yanez issued a Type A deficiency for violation of California Code of Regulations Title 22 Division 12 Section 102416.5(b)(3), which states: (b) For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be ... (3) More than six and up to eight children, without an additional adult attendant. LPA observed a census of 8 children, 1 infant and 7 preschool age children, no school age children present. This posed an immediate risk to the health, safety, or personal rights of children in care. Licensee submitted proof of corrections for this citation and the deficiency has been cleared.
On 05/02/2024, LPA Jeovanna Yanez issued a Type B deficiency for violation of California Code of Regulations Title 22 Division 12 Section 102417(g)(5), which states: (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to:(5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground) ... through a pool cover or by surrounding the pool with a fence. LPA observed an in-ground pool with 5 foot wrought iron fencing, and three (3) windows that have direct access into the pool area. This poses a potential risk to the health, safety, or personal rights of children in care. This plan of correction is still pending. (CONTINUED ON 809-C)
