13 | On 07/25/2022, Licensing Program Analyst (LPA) Stephanie Vega-Gonzalez conducted an unannounced inspection to initiate and close a complaint investigation at facility. LPA met with Licensee Manuela Garcia, explained purpose of inspection, toured facility and took a census of 11 children which includes 2 infants, and no assistant.
LPA observed and inspected hallway, living room, dinning room, family room, and kitchen. LPA interviewed Licensee Garcia Manuela and LPA obtained copies of facility contract records. Licensee stated that she did administered COVID-19 test on enrolled day care children on 7/15/2022 without parents’ consent.
Based on today’s interviews, documents reviewed it has revealed that the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated.
Per California Code of Regulations, Title 22, Division 12, Chapter 3, the following deficiency is being cited on the attached LIC 9099-D. Licensee is required to provide copies of this licensing report and 9099D with Type A citation to parents/legal guardians of children in care and to parents/legal guardians of children newly enrolled at the facility for 12 months from the date of issuance of any Type A citations. She is further reminded that she is to keep verification of receipt (LIC9224) in each child's file at the facility.
