25 | On 09/26/2024, Licensing Program Analysts (LPAs) Miguel Herrera and Julio Rodriguez conducted an unannounced case management inspection. LPAs met with Licensee Manuela Garcia to discuss the case management inspection. A tour of the facility was conducted, and census was taken.
During interviews it was revealed that day-care children were placed in a highchair for a brief period of time as a means of discipline. Furthermore, Licensee Garcia admitted to placing children in a highchair for a brief period of time as a means of discipline under her supervision.
Based on the interviews conducted it was determined that when children would become physically aggressive to either themselves or to other children in care, the licensee would place them in a highchair until they calmed down and were no longer a threat to themselves or other children in care. Although the intent in using the highchair was to protect children and other children, the highchair was utilized as a method of restraint and not for the intended purpose.
Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, LIC 809 D). Licensee Manuela Garcia was provided a copy of appeal rights. LIC 9213 Notice of Site visit form was provided to Licensee Manuela Garcia and is required to be posted for 30 days. This report shall be made available to the public upon request.
