On 11/17/23 Licensing Program Analyst (LPA) Denisia Jimenez conducted an unannounced Required 1-year inspection and met with Licensee, Ninfa Rodriguez. Also, present was the licensee’s husband/assistant. LPA took a census and there was 1 child and 2 infants in care. The licensee’s child was also present.

LPA confirmed with licensee hours of operation are Monday through Friday 4:00 AM to 4:30 PM and other hours as arranged. LPA also confirmed the family childcare home has a working telephone service, and Licensee confirmed the phone number is 559-871-8708.

LPA and licensee began the tour of the home inside and outside. Current facility sketch reviewed, and Licensee confirmed that the kitchen, dining area, living room #1, living room #2, and hallway bathroom are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible using doorknob spinners, and gates.

The licensee stated there is no swimming pool or other bodies of water on the premises. LPA did not observe any bodies of water. Licensee stated there are no firearms or ammunition on the premises. No poisons were observed during the inspection. LPA observed a cleaning compound and medication items that were made accessible to the children. LPA let the licensee know and she immediately removed the items. LPA explained to the licensee the importance of not having cleaning compounds, medicine, and other items accessible to the day care children that could pose a danger to them. The licensee understood. LPA will issue a Type B citation.

There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There are no stairs in this home. Safe toys and play equipment were observed. Adequate supervision was being provided during this inspection. Capacity as specified on the license was being maintained.

Based on observation and record review, the licensee did not comply with the section cited above. LPA observed in one of the kitchen cabinets advil and glucose medication, and in the restroom LPA observed a toothpaste and mouthwash on the bathroom counter, and Fabuloso liquid cleaner on top of the toilet lid which poses a potential health, safety or personal rights risk to persons in care.

The outdoor play area in the backyard is fenced. LPA observed in the backyard dog feces. LPA explained to the licensee the importance of having the dog feces picked up every day before the children go outside. The licensee understood. The licensee ensures that children in care are supervised at all times. The licensee currently has 6 dogs that are inside crates and are inaccessible to children. The licensee is aware of child safety around pets and accepts responsibility for any action taken by pets. The licensee is aware children shall not be left in parked vehicles and is aware car seats are used for transportation purposes only and are not used for sleeping children.

There are currently 2 infants in care. There is one crib or play yard for each infant in care, cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. The provider physically checks on sleeping infants every fifteen minutes and documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness, and labored breathing. The provider does not do the safe sleep logs. LPA explained to the licensee the safe sleep regulations and the importance of doing safe sleep logs. The licensee understood. Infants can be visually observed through an open door if sleeping in a separate room. Individual Infant Sleeping Plan is completed and in file for each infant up to 12 months of age. Infants up to 12 months of age are placed on their backs for sleeping.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The licensee has a current roster of children. A sample of children’s records contained all emergency information specified by regulation. LPA reviewed children's file and 2 of the children's file did not have the immunizations. LPA explained to the licensee the importance of having the immunizations in the children's file. The licensee understood and contacted the parents to get the immunizations. An emergency fire/disaster drill has been completed and documented within the last 6 months. Licensee’s Mandated Reporter Training was completed on 02/15/2023. Licensee’s pediatric CPR/First Aid expires on 02/2025. A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis, and measles.

All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

The licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Exit interview conducted and report was reviewed with licensee, Ninfa Rodriguez. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA verified the RSO profile in FAS.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page). The licensee was provided appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
