On 9/9/2022, Licensing Program Analysts (LPAs), Hanson Leong and Nathan Garcia, made an unannounced visit to the San Anselmo Preschool in response to a complaint. The LPAs were granted entry by the Director, Kathy Newman. The LPAs explained the purpose of the visit to the director. Guardian, the department's system for conducting background checks, has confirmed that all the individuals listed on the facility’s roster have been granted permission to work or be present in a childcare facility. The LPAs observed seven teachers supervising sixty-seven children inside the facility. Children's capacity and ratio requirements were observed to be in compliance,

During the investigation, all the pertinent information was gathered and examined, and all the parties involved were contacted and interviewed. The LPA was unable to identify whether the complaint that staff posing a threat to the safety of the children took place at the facility based on the interviews that were conducted with the staff. According to the interviews conducted with a member of the staff, the staff member admits to taking photos of the parent and the child. The director handed over the Photo Authorization and Waiver form, which all of the parents, including the one of the child belonging to the Reporting Party, had to fill out before the facility was allowed to take photographs of the children.

Based on LPA interviews and record reviews, the allegations, staff poses a threat to the safety of children and staff taking photos of children without permission, may have happened or are valid, there is not a preponderance of evidence to prove the violation did or did not occur; therefore, the above allegation is found to be unsubstantiated

Appeal rights was discussed with the director

“The Notice of Site Visit” shall be posted for 30 days.

Failure to maintain postings as required, will result in an immediate $100 civil penalty.
