1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25	On 2/21/24, Licensing Program Analyst (LPA) Joseph Pacheco and Centralized Application Bureau (CAB) Regional Manager (RM) Michael Duarte conducted an announced pre-licensing inspection and met with Executive Director, Heather Webster. CCL staff toured of the center and inspected the facility both inside and outside. The center is located at the address 9752 River View Rd, El Portal, CA 95318. Licensee is Yosemite National Park Childcare Center. LPA and RM observed children in care during today’s inspection. Per Executive Director facility has been operating as exempt from licensure due to being located on federal land but due to new federal guidelines, the facility is now required to pursue licensure from the State of California. This is a new facility, and the applicant is requesting a license for 3 infant children ages 4 months – 2 years, 14 preschool children ages 2-5 years and 8 school age children ages 5-12 years. This facility does not provide a Toddler component. This program will operate year round Monday through Friday with full day and half day options from 7:00 am – 5:30 pm. Ill children will isolate in the Executive Director’s office and will use the staff bathroom located in the Executive Director’s office. Applicant is aware to contact the Fresno Community Care Licensing office for a change in classrooms and/or change in capacity. Parents will escort the children to the classroom and staff will conduct the daily health check. Executive Director stated that the parents will provide all meals and snacks. Facility was advised that they will need to have a supply of food on hand in the event a parents forget to provide their child with food. Parents of infant children will provide baby formula and diapers. Parents of preschool children potty training will provide diapers. Facility was advised to keep a supply of formula and diapers on hand in the event the child runs out and the parents are not immediately able to replace the supply. Facility will provide baby wipes. Facility provides bedding sheets for infant who sleep in cribs and all children who nap on sleeping mats and/or cots. The infant, preschool and school age classrooms were observed to be clean and free of toxins. LPA observed that the furniture and equipment appeared to be safe and in good condition. The cubbies in the preschool and infant classrooms are anchored to prevent tipping onto children in care. Facility will need to anchor the cubbies in the school age room to prevent from tipping over. There are enough tables, cubbies, chairs and plenty of toys for children to play with in each respective age component. LPA also reminded Executive Director to not store anything on top of high shelves that could potentially fall on children. Facility has a working Carbon Monoxide detector.
LPAs reviewed with Executive Director, that any future changes to the classrooms are required to ensure that furniture does not tip over on to children, the furniture are to be anchored or situated that tipping does not occur. Classroom changes of furniture shall be situated that 100% visual supervision is always provided to children in care.
Room measurements were taken and reviewed with Executive Director. The total inside preschool area measured to an approximate 503 square feet which will accommodate the requested capacity of 14 preschool children. The total inside infant area is 131 square feet which will accommodate the requested capacity of 3 infant children. The total inside school age area is 303 square feet which will accommodate the requested capacity of 8 school age children. Executive Director understands that children's equipment needs to match the capacity El Portal Child Care Center is licensed for. Toys and equipment in each age component appeared to be age appropriate. There is a total of 1 toilet and 1 sink/hand washing fixtures in both the preschool classroom and school age classroom which will accommodate the requested capacity of that component. LPA and RM observed one sink in the infant classroom which will accommodate the requested capacity. The changing table in the infant area will need to be relocated so that it’s within arms reach of a sink while in use. Applicant will be providing toilet training. A drinking fountain in the preschool classroom was observed. Facility plans to purchase store bought water bottles to provide water to children in the infant and school age classrooms. Facility will need to purchase an igloo jug or similar water container to make water readily available to children in the infant and school age classrooms at all times. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). The outside square footage of the preschool outdoor area is in excess of 2,757 square feet which will accommodate requested capacity of 14 preschool children. The outside square footage of the school age outdoor area is approximately 1,849 square feet which will accommodate requested capacity of 8 school age children. The outside square footage of the infant outdoor area is approximately 1,132 square feet which will accommodate requested capacity of 3 infant children. LPA and RM observed age appropriate toys and play equipment in each component. LPA and RM observed a high climbing play structure with rubber chips for cushioning in the preschool area. A high climbing play structure was also observed in the school age area with no cushioning. The infant outdoor activity area did not have any high climbing play equipment.

Executive Director was unable to provide documentation showing that each play structure was age appropriate. The high climbing play structure in the preschool area will be off-limits until it can be either repaired or removed. Mature trees provide a shaded rest area in the preschool and school age outdoor play areas. Facility will need to come up with a way to provide a shaded rest area in the infant outdoor activity area. LPA and RM reminded Executive Director that visual supervision is to be provided to children in care at all times.
Facility Representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
LPA discussed the safe sleep regulations with Executive Director and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed Executive Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A fire clearance for 14 preschool children ages 2-5, 3 infant children ages 0-2 and 8 school age children ages 5-12 will need to be obtained from the local fire department.

The following items must be completed prior to issuing a license:

Inside Daycare:
1)Anchor cubbies in the school age area.
2)Move or make the changing table in the infant room mobile so it can be within arm’s reach of a sink while in use.
3) Heater, air purifier, and cots need to be removed from the school age room.
4) Additional cubbies are needed in preschool area and school age area and should be anchored if they touch the floor.

5) Sliding closet door in hallway has a hole and requires repair and should be off limits to children.

Outside Daycare:
1) Make the fence along the perimeter and that separates each component at least four feet high to meet required regulations.
2) Make the areas underneath the deck outside the kitchen and outside the school age classroom inaccessible.
3) The awning on the entry way of the property has chipping paint and needs to be repaired and painted.
4) Additional sand is required to be added to the sandbox.
5) There is a rain gutter near the back patio that needs to be repaired.
6) The area under the patio needs to be cleaned and made inaccessible for children.
7) The gates on the school age yard need to be secured and locked during day care hours.
8) The infant yard has two holes and some rocks that need to be removed, a storage shed that needs to be emptied and shade needs to be added to this area.
9) Low hanging tree branches need to be cut.
10) Adequate cushioning in the school age play structure area.

A return inspection will be needed to verify the above items have been corrected.

Required paperwork
1) Waiver request for commingling preschool and school age children for the first and last hour of the day.
2) Fire clearance as noted above.
3) A review of Heather Webster’s transcripts with course descriptions. After a review an exception request may be necessary.
4) Waiver request for the fence not being 4 ft height.

Pending a review of Heather Webster’s transcripts and other documentation showing she meets Title 22 requirements of a Director, a recommendation will be made to issue a provisional license to the above facility for the requested capacity of 14 preschool children 3 infant children and 8 school age children.
