13 | Licensing Program Analysts (LPAs) Robert Maciel and Jessica Gaumann conducted a follow-up visit to present the findings of a complaint investigation. It was alleged that the Licensee did not prevent an adult in the home from spanking day care child in care, specifically child 1 (C1) and that the Licensee hit C1.
During today's visit, LPA met with Licensee, Ericka Macias Ballesteros (LS) who was supervising 4 children. LPA conducted interviews with LS, adults, parents, and children between 8/4/25 and 10/23/25. On 10/6/25, LPA Maciel interviewed parents (P2 & P3) who stated that their children have never reported incidents to them regarding children being hit while in care which does not corroborate the allegations. On 10/2/25, LPA Maciel interviewed C1 who stated that she was not hit while in care which does not corroborate the allegation. On 8/7/25, LS showed LPA Maciel camera footage from the Ring camera in the playroom where children play and nap which did not contain any footage of children in care being hit or spanked which does not corroborate the allegations.
