32 | LPA discussed the following options with Licensee to bring pool inaccessibility into compliance:
1. Licensee could locate a swimming pool cover that meets specific guidelines and manufacturer’s requirements. (Licensee to check with Licensing prior to installing).
2. Licensee could buy a mesh fence that surrounds the pool, is anchored to the ground, and meets requirements as stated in the aforementioned regulation.
3. Licensee could extend the pool height to meet five feet.
The above options were discussed with Licensee during today’s inspection. LPA advised Licensee that children cannot be present if the pool is to remain filled with water while Licensee considers her options. Licensee started draining the pool while LPA was present. The pool cover does not meet Title 22 regulations, and Licensee understands the pool must remain emptied and the backyard play area will remain Off-Limits until follow up inspection is completed.
Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, the following deficiency is being cited during today’s inspection. (See next page, LIC809-D).
Upon receipt of a Type A violation, Licensee Lili Iniguez shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports were given to Licensee Lili Iniguez
Licensee Lili Iniguez provided a copy of appeal rights. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Licensee Lili Iniguez.
