On October 11, 2023 Licensing Program Analyst (LPA), Migue Herrera conducted an unannounced Annual Required Inspection and was met by Licensee Ericka Estrada. Days and hours of operation are Monday through Friday, 6:00AM through 6:00PM. The home has working telephone service and LPA confirmed the phone number is 209-850-5511.

LPA toured the home inside and outside and a census was taken. LPA conducted a census and there are 5 children in the home with Licensee, of which 2 of them are infants. Capacity as specified on the license is being maintained. All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home. LPA reviewed current facility sketch and confirmed that the daycare room, and bathroom #1 are used for providing care and are accessible to children. Safe toys and play equipment were observed and are in good condition, free of sharp, loose, or pointed parts. All other rooms are off-limits and made inaccessible by door level locks and baby gates. There are no firearms or ammunition on the premises. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible.

There is a fireplace in the home located in the living room and is made inaccessible by a screen and will not be in use during daycare hours. There is a working fire extinguisher located in the kitchen. The smoke detector and carbon monoxide detector are in working conditions. Licensee understands to test both smoke detector and carbon monoxide periodically for functionality. There is adequate heating and ventilation for safety and comfort of the children. Fire drills are conducted and documented with the date, time and how many children present, but the most recent fire drill was not conducted within the six month timeframe.

This is a two story home and the stairs are located in the daycare room. The stairs are made inaccessible to children in care by a baby gate. During the inspection, LPA observed safe toys and play equipment in the living room. The bathroom used by daycare children was observed to be free from hazards.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Based on observation, the licensee did not comply with the section cited above regarding the pool and spa located in the backyard that did not have a fence that met regulations. The pool was completely filled with water at the time of the inspection. The pool gates were not self-latching/self-closing, and the pool fence was unsecured and was able to sway which posed/poses an immediate health, safety, or personal rights to chidlren.

Licensee will comply with regulations by fixing the broken latch from gate #1 and will add springs to ensure the gates self-close/latches on both gates. Licensee will also ensure the pool fence is properly secured as it currently sways. Licensee states she will close on 10/12/2023 to ensure the pool is fixed immediately. Licensee will provide photos and videos to LPA by 10/12/2023 to document the completion of the plan of correction.

Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.

Licensee states that for the past two weeks children have not had access to the backyard since she has been working on a project. LPA Herrera asked licensee to inspect the backyard since there’s a pool in the premise. Upon inspection of the backyard LPA observed 4 dogs located in the side yard, the dogs were fenced inside a dog run. Licensee understands the liability of pets around day care children and accepts responsibilities of any action taken by pets. The outdoor play area in the backyard is fenced. There is an inground swimming pool and spa located in the backyard which is fenced. There are two pool gates that provide access to the pool. The pool gate located directly outside the home’s backyard is broken. LPA Herrera observed the gate being held closed by a chair placed in front of the gate. The latch has broken off the fence post, which causes the gate to swing open. LPA Herrera observed a spring behind the gate that no longer works and does not allow the door to self-close. The second gate located by the home’s side yard is not self-closing/latching and does not meet regulations. LPA Herrera also noticed the pool fence sway when LPA Herrera physically pushed the pool fence which posed an immediate risk to children. The inground pool and spa were filled with water during the inspection. Licensee is aware of child safety around the pool and assumes all responsibility. Licensee ensures that children in care are supervised at all times when they play in the backyard.

Capacity as specified on the license is being maintained. LPA reviewed a sample of children’s files and observed files were complete with emergency information as required. LPA Herrera observed complete immunization records for all children in care. Licensee’s Mandated Reporter Training was completed on 03/29/2023. Licensee’s pediatric CPR/First Aid certification expires on 04/15/2025. A review of records indicates that licensee has all immunization records on file for influenza, pertussis, and measles.

Licensee understands that there shall be one play yard for each infant in care, the play yard is kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the play yard. Infants are not swaddled while in care. Licensee did not provided proof of physically checking on infants every fifteen minutes and documenting any sign of distress, which includes but is not limited to flushed skin color, increase in body temperature, restlessness, and labored breathing on a sleeping log. Licensee misunderstood the regulation and believed it was children up 12 months that needed to have a 15-minute sleeping log on file. Licensee states she was given safe sleep logs that indicated “for children up to 12 months” which made her believe otherwise. LPA Herrera discussed safe sleep regulations with licensee and emphasized that infants up 24 months should have a 15-minute log on file. Licensee now understands the safe sleep regulations regarding the 15-minute sleeping logs and will document safe sleep every 15 minutes for infants up to 24 months. To be continued on 809-C.

LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 102416.2).

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Exit interview conducted and report was reviewed with licensee Ericka Estrada. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA verified the RSO profile in FAS.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see 809-D).

Licensee Ericka Estrada was provided appeal rights.

Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Licensee Ericka Estrada.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be provided and required to be posted for 30 days.
