25 | On 11/02/2023, Licensing Program Analysts (LPA) Miguel Herrera conducted a Plan of Correction inspection. LPA met with Licensee Ericka Estrada, who accompanied LPA on a tour of the facility. Present during today’s inspection were 6 children. The purpose of today’s inspection was to verify that the deficiency issued during the annual inspection on 10/11/2023 has been corrected.
On 10/11/2023, the facility was issued a Type A citation in violation of California Code of Regulations 102417(g)(5)(A) because the pool and spa located in the backyard did not have a fence that met regulations. The pool was filled with water at the time of the inspection. The two pool gates were not self-latching/self-closing, and the pool fence was unsecured and was able to sway which posed an immediate health, safety, or personal rights to children. Today, LPA Herrera opened pool gate #1 (immediately next to the sliding door exit) about a foot from the pool fence to test if the pool gate was self-closing/self-latching in which LPA Herrera was able to observe the pool gate self-close/self-latch. LPA Herrera observed the latch to be at the top end of the pool fence post and in good repair.
LPA Herrera proceeded to test pool gate #2 (west side of the house) in which LPA Herrera determined to be faulty. LPA Herrera observed the gate to self-close/self-latch inconsistently when opened about a foot away from the fence. LPA Herrera directed Licensee Estrada to tighten the spring on pool gate #2 to ensure it closed correctly. Licensee Ericka asked if she could use a lock and key to make pool gate #2 inaccessible to children. LPA Herrera agreed that it would be acceptable as long as Licensee Estrada ensured pool gate #1 not be locked in case of an emergency. LPA Herrera immediately observed Licensee Estrada lock pool gate #2 with a lock and key making it inaccessible to children. Licensee is aware of child safety around the pool and assumes all responsibility. Licensee ensures that children in care are always supervised when playing in the side yard. LPA Herrera advised Licensee to regularly maintain the pool fence/pool gate as weather, and normal wear and tear can degrade the pool fence/gates. Licensee Estrada understood the responsibility of maintaining the pool fence/gates.
Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, no deficiencies were observed today. Exit interview conducted with Licensee, Ericka Estrada. A notice of site visit (LIC 9213) was given and must remain posted for 30 days.
