On November 20, 2024, Licensing Program Analyst (LPA), Miguel Herrera conducted an unannounced Annual Inspection and was met by Licensee Ericka Estrada. Days and hours of operation are Monday through Friday, 6:00AM through 6:00PM. The home has working telephone service and LPA confirmed the phone number is 209-850-5511.

LPA toured the home inside and outside and a census was taken. LPA conducted a census and there was 5 children in the home with Licensee. Capacity as specified on the license is being maintained. All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home. LPA reviewed current facility sketch and confirmed that the daycare room, and bathroom #1 and the backyard are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible by door level locks and baby gates. Safe toys and play equipment were observed and are in good condition, free of sharp, loose, or pointed parts. There are no firearms or ammunition on the premises. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible.

There is a fireplace in the home located in the living room and is made inaccessible by a screen and will not be in use during daycare hours. There is a working fire extinguisher located in the kitchen. The smoke detector and carbon monoxide detector are in working conditions. Licensee understands to test both smoke detector and carbon monoxide periodically for functionality. There is adequate heating and ventilation for safety and comfort of the children. Fire drills are conducted and documented with the date, time and how many children present.

This is a two story home and the stairs are located in the daycare room. The stairs are made inaccessible to children in care by a baby gate. LPA Herrera reminded Licensee Estrada to ensure that the baby gate that is used to make the stairs inaccessible should remain closed and in good repair. LPA Herrera observed safe toys and play equipment in the living room. The bathroom used by daycare children was observed to be free from hazards. To be continued on 809-C.

(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Based on observation, the licensee did not comply with the section cited above regarding the pool and spa located in the backyard that did not have pool gates that met regulations. The pool was completely filled with water at the time of the inspection. The pool gates were not self-latching/self-closing, which posed/poses an immediate risk to the health, safety, or personal rights to chidlren.

Licensee will comply with regulations by fixing the spring to both pool gates to ensure the gates self-close/latches. Licensee states she will close on 11/21/2024 to ensure that the pool gates are fixed immediately. Licensee will provide photos and videos to LPA by 11/21/2023 to ensure the gates have been fixed. LPA Herrera will conduct a POC inspection at a later date to clear the POC.

Based on observations during today’s inspection, the licensee did not comply with the section cited above. LPA observed feces and urine scattered throughout the backyard from licensee’s pet miniature pig. Furthermore, LPA Herrera also observed a frying disk with cooking oil attached to a propane tank upon stepping to the backyard. Additionally, LPA Herrera observed that two out the three play yards were in disrepair and soiled, which pose a potential, health, safety or personal rights risk to children in care.

Upon inspecting the backyard LPA Herrera observed a miniature pig roaming the area. LPA Herrera observed feces and urine scattered in the back yard. LPA Herrera also observed a frying disk with cooking oil attached to a propane tank. LPA Herrera advised to ensure the area is clean before children go outside and play. License stated that she was cooking last night and forgot to clean the area after she finished cooking. Licensee Estrada stated that she forgot to clean after her pet pig this morning.

LPA observed 3 dogs located in the side yard, the dogs were fenced inside a dog run. Licensee understands the liability of pets around day care children and accepts responsibilities of any action taken by pets. The outdoor play area in the backyard is fenced. There is an in ground swimming pool and spa located in the backyard which is fenced. There are two pool gates that provide access to the pool. Both pool gates were not self-closing and self-latching and did not comply with regulations. LPA Herrera and Licensee Estrada opened the both gates approximately 6 inches and the pool gates didn’t self-close and self-latched. LPA Herrera and Licensee Estrada again opened the gates approximately 1 foot away and the gates didn’t self-close and self-latch. License Estrada then opened the gates at their full length to properly close the gates with force. Licensee stated that her children damaged the springs by propping the gates open during the summer. Licensee Estrada ensured she will have the springs repaired as soon as possible. The in ground pool and spa were filled with water during the inspection. LPA advised for licensee to conduct frequent safety inspections around the pool area and continue to maintain the pool fence as wear and tear can damage the pool fence. Licensee is aware of child safety around the pool area and assumes all responsibility. Licensee ensures that children in care are always supervised when they play in the backyard. However, today, Licensee Estrada decided to make the backyard inaccessible to children. Licensee Estrada will be using a safety latch that will be attached to the sliding door that leads to the backyard.

Capacity as specified on the license is being maintained. LPA reviewed a sample of children’s files and observed files were complete with emergency information as required and immunizations. Licensee’s Mandated Reporter Training was completed on 03/29/2023. Licensee’s pediatric CPR/First Aid certification expires on 04/2025. A review of records indicates that licensee has all immunization records on file for influenza, pertussis, and measles.

During today’s inspection LPA Herrera did not observe any infants present. However, Licensee Estrada stated that she has two infants enrolled. LPA discussed Safe Sleep Regulations with licensee. There are three play yards for infants in care located in the living room.

The play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Per licensee, infants are not swaddled while in care. Per Licensee, she physically checks on sleeping infant every fifteen minutes documenting sleep for any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness and labored breathing. LPA discussed the regulation surrounding safe sleep. Licensee understands that infants up to 12 months of age are to be placed on their backs for sleeping and must have an Infant Sleep Plan (LIC. 9227) on file. During the inspection LPA Herrera observed that two out the three play yards were in disrepair and soiled. Licensee stated that she will dispose of the play yard that has a hole on the mesh fabric and will clean the other play yard.

LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 102416.2).

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Exit interview conducted and report was reviewed with licensee Ericka Estrada. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA verified the RSO profile in FAS. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see 809-D). Licensee Ericka Estrada was provided with appeal rights.

Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Licensee Ericka Estrada. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be provided and required to be posted for 30 days.
