25 | On 12/05/2024, Licensing Program Analysts (LPAs) Miguel Herrera and Julio Rodriguez conducted a Plan of Correction inspection. LPA met with Licensee Ericka Estrada, who accompanied LPAs on a tour of the facility. Present during today’s inspection were 5 children. The purpose of today’s inspection was to verify that the deficiency issued during the annual inspection on 11/20/2024 has been corrected.
On 11/20/2024, the facility was issued a Type A citation in violation of California Code of Regulations 102417(g)(5)(A) because the pool and spa located in the backyard did not have a pool gate that met regulations. The pool gates were not self-latching/self-closing, which posed an immediate health, safety, or personal rights to children. Today, LPA Herrera inspected the pool fence and pool gates. The pool gate that is directly next to the home’s sliding door was now self-latching and self-closing. LPA Herrera tested the gate by opening the pool gate at different lengths and LPA Herrera observed that the pool gate was in good repair.
LPA Herrera observed that the pool gate to the west of the house to be locked with a key and lock. Licensee is aware of child safety around the pool and assumes all responsibility. Licensee Estrada understands that even though the backyard has been made off-limits to children in care she is expected to adhere to pool safety regulations.
LPA Herrera advised Licensee Estrada to regularly maintain the pool fence/pool gate as weather, and normal wear and tear can degrade the pool fence/gates. Licensee Estrada understood the responsibility of maintaining the pool fence/gates. Licensee Estrada's Plan of Correction for the above listed deficiency has been cleared during the visit and Plan of Correction letter will be provided to Licensee Estrada.
LPA Herrera advised Licensee Estrada that effective 1/1/2025 she is required to adhere to AB 2866 – Pool Safety: State Department of Social Services regulated facilities as they are no longer exempt from the Swimming Pool Safety Act. The Health and Safety Code requirements are included in Section 1596.814. LPA Herrera informed Licensee Estrada that a Provider Information Notice (PIN) will be issued at a later date.
Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, no deficiencies were observed today. Exit interview conducted with Licensee, Ericka Estrada. A notice of site visit (LIC 9213) was given and must remain posted for 30 days.
