32 | In accordance with the regulations cited above, Licensee has agreed to the following:
1. Licensee agrees to comply with Title 22, Division 12, Chapter 3 of the California Code of regulations.
2. Licensee will ensure children are provided with a safe and healthful environment, and comfortable accommodations furnishing, and equipment at all times.
3. Licensee will ensure the body of water is made inaccessible to daycare children, in accordance with Title 22 Regulations, and understands that pool gates should be self-latching/self-closing and children should not have direct access into the body of water.
4. Licensee will ensure that she will adhere to AB 2866 – Pool Safety that will take into effect on 01/01/2025.
5. Licensee will unsure that the home will be free from defects or conditions which might endanger a child.
6. Licensee will ensure to supervise infants while they are sleeping and adhere to documenting 15 minute check logs for infants up to 24 months of age.
7. Licensee will retake the Family Childcare Home Orientation and submit a certificate of completion to the department by January 14, 2024. Licensee shall submit a written plan to Community Care Licensing Division, indicating what she has learned and how she will comply with the above requirement within a week from completing Orientation. This is to ensure that Licensee is aware of Community Care Licensing Title 22 Regulations and to help her get a better understanding of bodies of water, infant safe sleep, supervision, inaccessible areas and the overall operation of a family childcare home. Licensee was referred to the Department's website: www.cdss.ca.gov.
In addition, it was recommended that Licensee connects with her local resource and referral agency for additional support and training. Licensee stated she already has contact information for her local resource and referral agency. Licensee was also informed about the Technical Support Program but Licensee indicated that she was not interested at this time.
Today, Licensee was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. Furthermore, Licensee understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties. A copy of this report was given to Licensee, Ericka Estrada. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiencies were cited during today’s Office Visit.
