Licensing Program Analyst (LPA) Fermin Campos-Jaramillo conducted an unannounced annual and increase of capacity inspection today. LPA met with Maria Tejeda, Licensee, and explained the nature of today's inspection to her. LPA observed there was one infant in care in today. Days and hours of operation are Monday to Saturday from 4:00 AM to 7:00 PM. The adults that reside in the home are the Licensee, her spouse Nazario, her adult grandson Johnny, and her granddaughter Alyssa. Licensee's certifications for CPR and First Aid card is current and will expire on 6/25/23.

LPA toured the indoor and outdoor areas of the home during today's visit. LPA requested a copy of the children's roster and it is complete and current. LPA reviewed eight children's files and are complete including the parent's rights form and the immunization records form. The licensee has last documented a fire/Disaster drill on 5/13/21. Licensee understand that a fire drill needs to be performed and documented at least once every six months. The Licensee has a working telephone (landline) in the home. LPA observed sufficient materials, toys, and play equipment for the day care children. LPA observed there is one wall heaters inside the home and it is barricaded. Off limit areas in the home: Master bedroom. There are not stairs or fireplace in the home. Off limit areas outside the home are 4 locked sheds in the back yard, one of which is used as a bedroom. The Licensee has four dogs in the backyard, the Licensee stated they are vaccinated and are in a fenced portion of the back yard.

LPA observed a fully charged 3A40BC fire extinguisher last time serviced on 3/25/22, working smoke and carbon monoxide detectors, and no bodies of water. The Licensee states that she does not have any weapons in the home. All detergents, cleaning compounds, medications, and other similar items are stored inaccessible to children. LPA discussed IMS with the Licensee. Licensee has submitted before an statement declaring immunization for measles and pertussis, and has in file proof of receiving immunization for the seasonal flu.

(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.

Supervision of children was discussed with the Licensee and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. The Licensee understands her capacity options and she understands that she cannot have more than 8 children in the home at any time. The Licensee states that she transports children via vehicle and she understands that children cannot be left in parked vehicles unattended at any time.

LPA discussed the requirements of AB 633 with the Licensee. LPA also discussed "zero tolerance" related regulations with the Licensee.
LPA observed that licensee has not renewed the "mandated reporter" training (AB1207) since 3/10/21. Licensee understands the training is mandatory for all the adults in contact with children in a Family Child Care Home, and shall be renewed every two years. Licensee was informed the training is now available in Spanish language. LPA referred the Licensee to the Department website: www.mandatedreporterca.com. for additional information on the online training.

LPA observed that a fire clearance was granted by the City of Salinas Fire Department to this home on 4/21/22.

A review of staff records on 4/26/22 indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Licensee Maria Tejeda was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Exit interview conducted and report was reviewed with the licensee Maria Tejeda.

Two type B deficiencies were cited today.

A notice of site visit was given and must remain posted for 30 days.

Licensee was informed that failure to correct the deficiencies by the specified Plan of Correction Due Date will result in assessment of civil penalties in the amount of $100 per day per violation until the correction is made.



LPA conducted an exit interview with licensee Maria Tejeda in Spanish and informed her that a large FCCH license will be approved pending on the following: 1) Applicant to clear the two type B deficiencies cited on page LIC809D, and 2) Approval from a manager of the Licensing Department.
