Licensing Program Analyst (LPA) Fermin Campos-Jaramillo conducted an unannounced annual inspection to the home today. LPA met licensee Rosaisela Reynoso and explained to her the purpose of the inspection.
Days and hours of operation are Monday to Friday from 6:00 AM to 6:00 PM. Licensee stated the adults that reside in the home are herself, and her spouse Jose Edith. Licensee stated also in her home resides her minor children ages 11 and 3 year old. At arrival LPA observed 7 children were present, including 3 infants and 4 preschool age. Licensee was out of ratio today. Licensee called parent of two minor children (ch1 and ch2) to come and pick up the children, the parent arrived 25 minutes later. LPA provided licensee with a graphic explaining the ratio for an small license.

Licensee has current certification for CPR and First Aid expiring on 7/26/24.
LPA toured the indoor and outdoor areas of the home during today's inspection. LPA took a picture of the Child Care Facility Roster. LPA reviewed five of the children's files. Licensee documented the last fire drill on 2/24/23. The Licensee has a working telephone in the home.
LPA observed sufficient materials, toys, and play equipment for the day care children. Off limit areas in the home are: 3 bedrooms, the attached garage, and one bathroom. LPA observed a barricaded fireplace in the living room. The fireplace is blocked with furniture and is not accessible. Off limits outside are the right and the left side yards. LPA observed the home has a back yard and it is fenced. Licensee uses the back yard as playground.
LPA observed a fully charged 2A10BC fire extinguisher last time serviced on 7/26/22, working smoke detectors and no bodies of water. LPA observed a working carbon monoxide detector in the home. The Licensee states that she does not have any weapons in the home. All detergents, cleaning compounds, medications, and other similar items are stored inaccessible to children.
LPA observed licensee has in file proof of immunization for pertussis, influenza and measles according with the SB792.

Based on observation the licensee did not comply with the section cited above. Licensee was found providing care to seven children: 3 infants, 4 preschool, no school age present. which poses an immediate health, safety or personal rights risk to persons in care.

Licensee called parent of the siblings children #1, and #2 to pick them up during the inspection. Licensee will submit an statement that she understands the ratio for an small licensee by the close of business of 4/28/23. LPA discussed the requirements of AB633 to licensee and provided her the AB633 fact sheet and a copy of Acknowledgement of Receipt of Licensing Reports (LIC 9224) and licensee understands the requirements. Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Licensee will submit a copy of the signed forms lic9224 on or before May 5, 2023.

Supervision of children was discussed with the Licensee and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. The Licensee understands her capacity options and she understands that she cannot have more than 14 children in the home at any time and a helper must be present and ratio (age of the children) must be observed. Licensee understands that in absence of a helper her license capacity is reduced to only 8 children, and ratio must be observed too. Licensee stated she does not transport children via vehicle and she understands that children cannot be left in parked vehicles unattended at any time.

LPA observed that licensee has renewed the required "Mandated Reporter" training, AB1207 on 7/25/22 which is mandatory for licensees and all the adults in contact with children. Licensee understands the training shall be renewed every two years. LPA provided Licensee with the website address for additional information: www.mandatedreporterca.com

A review of staff records on 2/28/23 indicates that all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

Licensee Rosaisela Reynoso was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the requirements of AB633 to licensee. One type A and one type B deficiencies were cited today.

Failure to comply with the Plan Of Corrections (POC) by the due date on LIC809D shall result in an immediate civil penalty of $100 per day per each deficiency.

A notice of site visit was given and must remain posted for 30 days.
