An unannounced case management visit was made to the facility by Licensing Program Analyst (LPA) Mindy Mohr in response to a self-reported incident involving Child (C1) that occurred on 02/21/2025. It was reported that a child was left unattended in a classroom for an hour. During today's visit LPA observed 16 children being supervised by three staff. LPA also met with Director Jennifer Bator (D1) to discuss the incident.

It was reported on 02/21/2025 Child (C1) was given permission by Staff (S1) to enter an empty classroom to get their lunch box. D1 stated that C1 was found in the classroom by another adult (A1). A1 heard C1 yelling and banging on the door. A1 opened the door and C1 was standing at the door crying. D1 stated S1 told her they forgot they had let C1 go to the other classroom, and that C1 had been in the classroom alone for roughly one hour. It has been determined that S1 did not provide adequate supervision to C1. This is a repeat violation of an absence of supervision incident that occurred at the facility on 05/20/2024.

An immediate $1000 civil penalty is being assessed today for a repeat absence of supervision. This report was reviewed and discussed with Director Jennifer Bator. Notice of Site Visit shall be posted for 30 days from today's visit. The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided.
LPA informed Director Jennifer Bator that this report dated 03/05/2025 documents one Type A citation. Type A citations shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

LPA informed the Director Jennifer Bator to provide a copy of this licensing report dated 03/05/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

The department shall assess an immediate civil penalty of $500 per violation and $100 for each day the violation continues after citation, for any of the following serious violations: Absence of supervision, including, but not limited to, a child left unattended, and supervision of a child by a person under 18 years of age.

D1 stated they immediately held a staff meeting regarding the incident, the importance of supervision, and have purchased walkie talkies to help staff communicate with one another while in the classrooms, or out on the play yard.

This requirement has not been met as evidenced by: Based on the Director's own admission on 02/21/2025 C1 was left alone in a classroom without staff supervision for roughly one hour.This posed an immediate health and safety risk to the child(ren) in care.

D1 also stated she will submit a statement on how the facility will train / on board staff regarding supervision. D1 will email it to LPA Mohr at: melinda.mohr@dss.ca.gov
