32 | Children interviews (C1-C8) provided corroborating evidence, confirming that the time out area is alone in the ‘block room’ with the door closed. In addition, teachers pull children by their arms and/or shirts and drag them, specifically with the younger children’s feet dragging on the floor, and sometimes picking the children up by their clothing and then dropping them to the floor. One child demonstrated how the teachers grab the younger children and drop them onto the floor. It was further noted that when the children cry after being grabbed, they go to time out until they stop crying. Two interviews revealed that S4 spanked C7. It was further disclosed that the teachers have a new rule not to spank children anymore. Six of the children interviews confirmed that teachers yell a lot, specifically identifying S1, while two children stated teachers tell them to shut up.
Adult interviews (A1-A6) revealed they have observed the teachers yell or scream at children and handle children in a way that is inappropriate, specifically observing S1, S3, S4 and S5 grab and pull the children by their arms and/or clothing. A1 observed S4 yanking a child off of the play structure. A3 heard a child crying alone in a room with the door closed and when the child opened the door, S4 told the child to stay in there and close the door. A6 has observed children sitting alone at tables or in the corner with their heads down and heard S1 yell at a child to sit and put their head down. An adult interview also stated a child confirmed two friends got spanked by a teacher at school.
Based on the investigation, the preponderance of evidence standard has been met. Therefore, the above allegations are found to be substantiated. The following violations of the California Code of Regulations, Title 22; Division 12: see LIC 9099D.
Civil penalties are assessed on form LIC421FC for repeat violations within 12 months, in the amount of $250 for each repeat violation, for a total amount of $500 assessed today.
