Licensing Program Analyst (LPA) Mindy Mohr made an unannounced complaint investigation visit today, and met with Licensee, Jacqueline Wisniewski, for the purpose of delivering findings of the above allegations. LPA Mohr and LPM Lepori previously met with Jacqueline on 10/07/2024 to open the complaint. A subsequent visit was made on 10/29/2024 to further investigate the complaint allegations.
During the course of the investigation, LPA Mohr conducted interviews and received documents pertaining to the investigation. From 10/04/2024 through 10/29/2024, interviews were conducted with Licensee (L1), Assistant (S1) five parents (P1-P5) and four children (C3 – C6).

Licensee (L1) denied all allegations. L1 stated she is always present, and her assistant is never alone with the children except when she picks up her child from school, which is rare. L1 stated that the children sit in their cubbies during transitions, upon arrival when they take off their shoes and then wait in their cubby to be called to wash their hands. The cubbies are also used when a child needs to calm down, they will sit in their cubby for 5-10 minutes. The children will also sit in their cubbies at the end of the day as parents have asked for their children to be ready for pick up. L1 claimed that parents are allowed to enter the facility if they ask, they like to stand at the door. Parents are welcome to go inside but they need to hide, as L1 does not want the children to see the parents and get distracted. L1 also stated that is why there is a curtain in the entryway of the facility as well as to block the light but that it is “always open when the children are awake”.

S1 stated she has been left alone with all of the children when L1 drops off and picks up her own child. S1 confirmed that children sit in their cubbies every day starting at 4:50 pm until they get picked up. Also, when they are in trouble, such as if they got into a fight or are crying they will sit in their cubby for a period of 5-10 minutes while staff will walk from the kitchen to the playroom and then back to the cubby. Furthermore, S1 stated when an infant is crying and needs some time, they are separated from the other children and put into a crib in the bedroom. S1 also stated that parents are allowed to enter the facility if they ask, but that they like to stand outside at the door. S1 also stated the curtain by the front door stays closed so the children do not get distracted and that they have closed the door to the bedroom when infants are asleep, but now L1 uses a curtain for that.

Parent interviews (P1 – P5) all state they drop off and pick up their children at the door and have never been asked to enter the facility, while P5 further stated the rules for drop off and pick up is that parents are not allowed to enter the facility due to separation issues. Interviews with P1, P3 – P5 all revealed that they are aware that children sit in their cubbies while waiting to be picked up with P1 and P4 stating the window pick up time can be from 4:30 to 5:30 pm.

P3 – P5 stated they were told by L1 that children sit in their cubbies when they do not listen or cause problems, while P5 stated L1 told them the cubbies are used as punishment. P3 further stated that the curtain is usually closed, referring to the curtain at the entry way leading to the playroom. P5 also conveyed that their child said the L1 yells when children don’t listen and P1 has heard L1 say to a child “why are you crying, you are not talking”. P4 thinks L1 is very strict, and children are afraid of not following the rules. P4 also has heard her child say that L1 hurts their feelings.

Children interviews (C3, C4 & C6) all corroborated they sit in their cubbies when they are in trouble, or waiting to be picked up by their parents. C3 further stated that sometimes when they are sitting in their cubby they cry, while C4 stated they sit in their cubby a lot. C3, C4 & C6 all state when the babies are crying, they are put into their cribs in the bedroom for time out or to calm down when they cry. C6 further stated the babies cry in there for a long time. C3 and C6 also stated that teachers (L1, S1) sometimes yell when they don’t listen and/or that their voices get loud.

During a visit on 10/03/2024 LPA Mohr observed S1 supervising 11 children alone, while L1 was in a back bedroom, S1 would call the children into the kitchen to eat snack while the other children stayed in the playroom waiting to be called. The children did not talk while eating and when done with their snack, children sat in their chair until they were called to get up. At 4:50 pm children walked into the kitchen and sat in their cubbies. The children put their shoes on and waited until L1 would call them to the front door as their parents/ guardians arrived. LPA observed the first child picked up at 5:00 pm and at the time of LPA’s departure at 5:24 pm there were two children still sitting in their cubbies. Neither L1 or S1 spoke with the children while they were sitting in their cubbies. LPA observed cubbies to have children’s belongings in them, leaving a small space for the children to sit.

During another visit on 10/29/2024 upon LPA’s arrival at 8:02 am, L1 was not present, leaving S1 alone with the five preschool age children and one infant. LPA also observed a child (C7) was quietly sitting in their cubby. S1 stated that C7 had just been dropped off and was taking off their shoes. It was revealed during record review that C7 had been dropped off at 7:30 am that morning. S1 stayed in the kitchen while the other children played in the playroom, the curtain that leads from the entry way to the day care area was observed to be closed. Also observed is a sign posted on the front door stating “Drop off and pick up at outside door only".

In addition, evidence received depicted child(ren) continuously crying without the attention of or being comforted by staff. The children were either sitting at a table, in a highchair or standing while crying. On multiple occasions the children had either just vomited or were actively vomiting as seen on video provided to LPA by L1. L1 stated the children are tired of their food, which is what makes them vomit. S1 confirmed they leave the child(ren) alone and do not go to them. They do not clean the child(ren) for a while to make sure they are done vomiting.

Based on the investigation, the preponderance of evidence standard has been met. Therefore, the above allegations are found to be substantiated. The following violation of the Health and Safety Code is being issued: see LIC 9099D.

Exit interview was conducted, and report reviewed with Licensee Jacqueline Wisniewski.

LPA Mohr informed Licensee that this report dated 12/19/2024 documents two Type A citations. Type A citations shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

LPA Mohr informed Licensee to provide a copy of this licensing report dated 12/19/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Licensee (L1) denied all allegations. L1 stated when an infant arrives in their car seat, they are taken out as soon as possible and the car seat is put in the other room. L1 further stated the car seat is not used for any other reason. S1 stated when an infant is dropped off in a car seat, the child is taken out of it and their hands are then washed. The car seat is then taken to the bedroom.

According to P2 their child (C8) is dropped off in their car seat and when they pick up the child is in their car seat. P2 further stated they pick up at different times, so they are unsure how long the child sits in their seat. C6 stated there is a baby (C8) who sits in their car seat waiting to be picked up while they sit in their cubby waiting to be picked up. It could not be determined how long the child was sitting in the car seat while waiting for pick up.

Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred and therefore is determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with Licensee, Jacqueline Wisniewski. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
