32 | Six adults (A2-A3, A5-A7, A9) stated the facility does not provide a sufficient amount of toys and toys/ equipment are not consistently maintained or not in good condition. In addition, adult interviews revealed children frequently argue over toys due to limited availability, specifically in the outdoor play yard, and popular items such as dump trucks, ride-on toys, and outdoor kitchen materials are often broken, missing, and not replaced. Furthermore, adult interviews revealed requests for new, or replacement toys are communicated to the director but the requests are not addressed promptly.
During the site visit on 11/06/2025 LPAs observed toys and equipment available to children that were rusted, in disrepair, and contained sharp edges, posing a potential safety hazard. Specifically, LPAs observed the outdoor play yard to include two sections, which are separated by a fence. LPAs observed the following toys and equipment available to children in the front section of the play yard; 7 metal dump trucks, 5 plastic trucks, one outdoor play kitchen with 2 plastic spoons / scoops, 9 various sized metal bowls, 3 metal / plastic strainers, and 3 rusted misshaped pie tins, 2 ride-in cars, 9 tricycles, two child sized picnic tables, wooden stair structure with a child sized play table, 2 sensory tables empty, 1 merry go round with 5 tricycles attached, 4 plastic seats with a steering wheel attached, 3 basketball hoops, 2 see-saws, 1 log cabin and 6 chairs that were stacked. At approximately 3:17 pm to 3:38 pm, LPAs observed 37 children enter the front section of the outdoor play yard. The children stayed in this area to play while LPAs were present. These observations corroborate statements from adult interviews.
Based on the investigation, the preponderance of evidence standard has been met. Therefore, the above allegations are found to be substantiated. The following violations of the California Code of Regulations, Title 22; Division 12: see LIC 9099D.
This report was reviewed and discussed with the facility’s representative, Milli Pintacsi. Appeal rights were provided. A Notice of Site Visit shall be posted for 30 days from today’s visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
