32 | Licensee denied the allegations, stating she has never handled a child in a rough manner. L1 further stated children will run at her, and that she will put her hands up to stop the child, but she has never pulled a child in an aggressive manner. In addition, L1 stated that the facility has not had any injuries, however there was an incident where a child was hit in the head with a toy to which L1 was unsure if the child received medical treatment. L1 also stated the facility has a star system, when a child had an incident occur while at school, staff put a star next to the child’s name in the sign in / out binder and parents know they are to check in with a teacher. Furthermore, L1 stated children have conflict, but it is not bullying. If children are upset staff talk to the children about their feelings and re-direct the child. L1 also stated children do throw toys over the fence, however a child was never taken off the premises.
Staff interviews (S1-S3) all stated they have never seen any staff handle a child in a rough manner. S1 further stated that when they have grabbed a child, the child pulls so they let go so they do not hurt the child, but not in an aggressive way. All staff stated children have not had any serious injuries, they use a notebook to log injuries and incidents, they then put a star next to the child’s name and parents know to talk to them. S1 stated parents know to talk to them if there is a star, however sometimes they forget or do not have time to write the injury down, and if they forget they tell the parents the next day. While S3 stated when there is an injury or incident it gets logged into the teacher log, however, there is not a report that is written for parents. In addition, S1 -S3 all stated children throw toys over the fence, but children are not taken off the premises to get retrieve the items. S2 stated they do not see a lot of bullying, just hands on incidents, for example hitting and biting, however when that happens the children are separated and re-directed. S3 stated the children are not bullying each other, they are being children.
Adult interviews (A1 -A3) all stated they have never seen a child handled in a rough manner or have ever seen a staff member take a child off the premises. A1 – A3 all stated they were not aware of the star system the school uses. A1 – A3 all stated they did not have any concerns with the facility.
Based on the information gathered during this investigation, although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with Licensee, Cecilia Woods. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
