32 | Investigation consisted of five Staff (S1-S5) interviewed on 5/25/22, 10/11/22 & 10/12/22, seven Parents (P1-P7) interviewed on 5/25/22, 10/11/22 & 10/12/22, Licensee (L) interviewed on 7/7/22 & 10/12/22, , two Children (C1 & C2) interviewed 5/25/22, document review and observations made 5/25/22 & 7/7/22. Some children were not verbal, too young to interview, or did not qualify to be interviewed.
Adult statement ( A1) reported that child (C1) expressed to them that child (C1) was touched inappropriately by child (C2) in the play yard but no other individuals or staff were able to confirm that they saw that incident occur. LPA observed adequate overlapping, spaced out supervision coverage in the play yard and staff interviewed S2-S5 reported that three to four staff are always in the yard supervising children during outside play. Parents (P1-P7) had no issues with staff supervision. Children did not corroborate the allegation.
Staff S2 reported that one of the teachers that was elderly would ask for help with certain tasks like opening a container for the children. S3 stated that she had to remind staff in question to drink water during hot days so as to not feel disoriented. Licensee (L1) stated that he kept a close eye on staff in question and that she was reported to be at full capacity. L1 eventually changed staff in question's duties to reading to the children and she was not included in the ratio. This staff member retired in June, 2022.
Parent interviews could not corroborate the above allegations.
Based on the information gathered during this investigation through interviews and observations, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited on the above allegations. This report was reviewed and discussed with the Facility Representative, Kaylee Andres. Appeal Rights were provided.
