Licensing Program Analyst (LPA) Mindy Mohr made an unannounced complaint investigation visit today, and met with Site Supervisor, Mayra De La Cruz, for the purpose of delivering the findings of the above allegation. LPAs Mindy Mohr and Cindy Castro previously met with Child Development Coordinator, Michele Eggert, on 10/04/2023 to open the complaint. A subsequent visit was made on 10/23/2023 to further investigate the complaint which alleged that staff did not prevent a child in care from wandering away from the facility.

During the course of the investigation LPA, Mohr toured the facility, received documents, conducted interviews, and made observations. From 10/04/2023 through 11/21/2023, interviews were conducted with Child Development Coordinator, Site Supervisor, 4 staff (S1-S6), one child (C2), two adults (A1 & A6) and attempted other adult interviews.

All staff interviews conducted confirmed that C1 did leave the classroom unnoticed and wandered into the parking lot. Interviews varied on how the child was able to leave the classroom unsupervised. When S2 realized C1 was outside, S2 immediately left the classroom to get C1. S2 noticed the gate to the parking lot was open and saw C1 standing by a car in the parking lot which was approximately 50 to 60 feet from the sidewalk. When S2 reached C1, C1 ran further away but C1 was in view the entire time they were running through the parking lot. S4 was in the classroom at the time C1 ran out but went out of the classroom to help S2. S5 was in the classroom with the other children while S2 and S4 were out with C1. Staff stated that the entire incident lasted approximately one minute.

Based on the investigation, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be substantiated. The following violations of the California Code of Regulations, Title 22; Division 12: see LIC 9099D. Appeal rights were provided.

Exit interview was conducted and report dated 12/04/2023, which documents one Type A citation, was reviewed with the Site Supervisor, Mayra De La Cruz who was informed that Type A citations shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Mohr informed the facility representative to provide a copy of this licensing report dated 12/04/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolling parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensing Program Analyst (LPA) Mindy Mohr made an unannounced complaint investigation visit today, and met with Site Supervisor, Mayra De La Cruz, for the purpose of delivering the findings of the above allegations. LPAs Mindy Mohr and Cindy Castro previously met with Child Development Coordinator Michele Eggert on 10/04/2023 to open the complaint. A subsequent visit was made on 10/23/2023 to further investigate the complaint which alleged day care child sustained injuries while in care and staff left day care child in a soiled diaper for a long period of time.
During the course of the investigation LPA, Mohr toured the facility, received documents, conducted interviews, and made observations. From 10/04/2023 through 11/21/2023, interviews were conducted with Child Development Coordinator, Site Supervisor, 4 staff (S1-S6), one child (C2), two adults (A1 & A6) and other adult interviews were attempted. Interviews with S1, S3 and S5 revealed that children do get hurt while at school, but mainly involves typical bruises and scratches from falling or playing. S1 stated when a child gets injured at school, they send a report to the parent and then to CCL if necessary. A1 stated they are not concerned of their child getting hurt at school as children fall often. There was no evidence to correlate the injuries to a violation of regulation.

Statements from S1, S3 and S5 state that children have their diapers checked often and changed as needed. S3 also stated that children are scheduled for three times a day for diaper changes. Furthermore, interviews revealed that one child had just woken up from a nap with a soiled diaper, but the child ran straight to their guardian before the diaper could be changed. A1 stated their child is not in diapers so they are unsure of the policy with diaper changing.

Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility’s Site Supervisor, Mayra De La Cruz. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.

Site Supervisor has had multiple staff meetings regarding supervision, and has added signage to the front gate about latching the gate when going in and out. Site Supervisor has also sent out email to families, and had parents meetings reminding families to latch the main gate.
