32 | Interview with SS reported that she was in her office and not present in the room at the time of the incident. SS confirmed the incident did occur, further stating a bookshelf was pushed over in the classroom, which fell onto the child standing next to the light table. SS reported that since the incident, all furniture, including bookshelves, has been anchored to the wall using L shaped brackets. Staff reviewed supervision protocols, including maintaining visual supervision and following safety procedures.
Interview with S1 reported they were seated at the table, supervising another child. S1 reported that they were the closest staff member to the incident, while the other staff member was working at a separate table across the room. S1 stated that C2 was playing in the circle time area on the other side of the bookshelf that they pushed over. S1 reported they heard a noise and when S1 looked up, saw the bookshelf (31”high x 12”wide x 48”long) tilting toward C1, who was on the opposite side of the bookshelf playing at the light table. S1 immediately approached and observed that C1, was on the ground but not trapped. S1 stated the light table may have prevented the bookshelf from fully falling onto C1.
P3 interview revealed when they arrived at the facility following the incident, the shelf involved was already upright .
Based on LPA’s interviews and observations, the preponderance of evidence standard is satisfied. Therefore, the above allegations are found to be substantiated. The following violations of the California Code of Regulations, Title 22; Division 12: see LIC 9099D.
This report was reviewed and discussed with the facility’s representative, Andrea Karjack. Appeal rights were provided. A Notice of Site Visit shall be posted for 30 days from today’s visit. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
