An unannounced complaint investigation visit was made to the facility by Licensing Program Analyst (LPA), Mindy Mohr to investigate allegations filed against the facility. LPA met the facility's Site Supervisor Mayra De La Cruz (S1) today to discuss the allegations. Interviews were also conducted with 3 staff (S2-S4), documents pertaining to the investigation were obtained from the facility. It was alleged that staff did not prevent day care child from leaving room unattended.

Staff interviews revealed that on 02/13/2024 C1 left their classroom, Preschool 2 alone. C1 went through the main door, wandered through the courtyard and then into the Infant classroom. The Infant classroom is unoccupied at this time. S1 stated the door to the Preschool 2 classroom usually has an alarm that goes off, but the batteries where not working as of that morning. The door to Preschool 2 was closed when C1 wandered out. S4 stated there were two teachers in the classroom when C1 wandered out. S4 stated they realized C1 was gone and ran out of the classroom and saw another teacher bringing C1 back to the Preschool 2 classroom. S4 stated C1 was alone for approximately 5 minutes.

Based on staff interviews, there is a preponderance of evidence to show there was absence of supervision which resulted in C1 leaving the classroom alone, therefore the allegation is substantiated.

The facility did not comply with Regulation 101229(a)(1) Responsibility for Providing Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time. Title 22, Division 6, Chapter 3.5 violation is being cited on the following LIC 9099D.

Exit interview conducted, and report was reviewed with Site Supervisor Mayra De La Cruz and Director Darrell Whitacre.

A notice of site visit was given and must remain posted for 30 days.

LPA Mohr informed Site Supervisor Mayra De La Cruz and Director Darrell Whitacre that this report dated 02/28/2024 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

LPA Mohr informed Mayra De La Cruz to provide a copy of this licensing report dated 02/28/2024 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

S1 stated they had a staff meeting and went over supervision. S1 stated she has mad a log for batteries and the door alarms making sure they are changed regularly. S1 also stated she has contacted the maintanence manager regarding putting a gate at the cubbies by the main classroom door that will prevent children leaving the classroom.

Based on interviews C1 was left without staff supervision for 5 minutes while leaving their classroom alone, walking through the courtyard and into another classroom on 02/13/2024 which posed an immediate health, safety and/or personal rights risk to the child in care.

LPA gave S1 the 'Active Supervision' and 'Active Supervision Toolkit' handouts. S1 stated she will go over the handouts with staff at the next staff meeting.
