32 | Statements from A1 – A3 all corroborate that their children have been clean when picked up and teachers assist the children, both in diapers and when potty training. A4 stated that their child had a wet diaper when picked up and has not been fully cleaned during a diaper change.
S1 denied the allegation that staff are retaliating due to a complaint being filed, specifically that C1 was sent home early and on another occasion was in clothing that was not appropriate for the weather. S1 stated that when children are sick, they cannot be at school, and if a child becomes ill while at school parents are called and expected to pick up their children in a timely manner. Additionally, parents must have more than one emergency contact who can be called when the parent is not available. Adult interviews (A2-A3) revealed that children cannot be at school while sick and if they become sick while at school, parents will be notified to pick the sick child up. A4 stated they were called to pick up their child from school when the child was not sick. Staff interview (S2) stated one afternoon C1 was put into different clothing as C1 refused to wear specific clothing that was provided, the parent was upset with the situation. There is not enough evidence to correlate the facility was retaliating as a result of how the child was treated.
Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the facility’s Site Supervisor, Mayra De La Cruz. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
