Licensing Program Analyst (LPA) Glenn Ouye arrived to continue the complaint investigation and deliver findings. The allegation is that staff withheld food from a day care child, specifically the child's food was withheld from a child in a punitive manner for the childs behavior. During the investigation, LPA interviewed children and adults which include parent and staff. On one occastion a child C1 was presenting a challenging behavior when transitioning from outdoor activity to lunch. If a child is unable to regulate themselves the teachers will wait and work with the child until the child is calm and ready to eat. When the child is aware that they have calmed, the child will then be served the lunch. While there can be delays in the child eating their meal, the childs meal is saved for the child until the child is ready to eat. This prevents the food from being thrown or distroyed by a child who may be upset and unable to self-regulate themself.
Based on the interviews conducted there is not a preponderance of eveidence to support that staff withheld food from day care child did or did not occur. The allegation is therefore deemed to be unsubstantiated.
