Licensing Program Analyst (LPA) Jen Patel made an unannounced Case Management Legal/Non-Compliance visit today and met with Tamara Kinman (D1) to ensure compliance with the terms set during a prior Stipulation and Waiver and Decision and Order. The Department's Stipulation Waiver and Order was effective as of 09/02/2025 with a probationary licensee granted until 09/02/2028. The facility agrees to adhere to the following terms and conditions of the Stipulation and Waiver; and Order:

A. Respondents shall obey all federal, state, and local laws.

B. Respondents shall strictly comply with all statutes and regulations related to child day care centers.

C. Respondents shall obtain, install and maintain video camera recording equipment for the interior and exterior areas of the facility, wherever children are present.

D. The implementation of video camera recording is subject to the best practices for daycare facilities utilizing video surveillance and privacy equipment includes: clear signage, notice and parental consent, protection of children's privacy rights, restricted camera access and retention policies for review by licensing personnel.

E. Respondents shall inform all current and prospective parents of children enrolled in the facility, of the facility's probationary license by making available to the parents copies of the Accusation and this Stipulation and Waiver and Decision and Order until the probationary term has expired. Parents shall sign a LIC9224. Each original notification form shall be maintained by the Respondent in the appropriate child's records folder and be made available to the Department upon request, and the parent shall be provided with a copy.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:

Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.

Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

F. Licensee Brenna Roth (L1) and Director Tamara Kinman (D1) shall complete a 12-hour course in child appropriate discipline and supervision techniques, within the first 60 DAYS of probation.

G. Licensee Brenna Roth shall attend courses and training that include the following subjects; operation of a licensed childcare facility, positive intervention and counseling techniques, a course related to stress intervention/anger management and shall engage is support for childcare professionals.

H. Respondent licensees and employees shall participate in a minimum of eight hours (8) of annual training, in addition to other mandatory training imposed by licensing laws and regulations, for all staff. Initial training shall occur within four months of the effective date of this Stipulation and shall include training on compliance with regulations, including personal rights and reporting requirements consistent with the obligations of Title 22, and shall also include training focusing on child development, discipline, and behavioral issues. All newly hired employees shall receive the above described eight hours (8) training within 60 days of commencing or returning to employment.

A copy of the Stipulation and Waiver; and Order was posted inside the main entrance for parent viewing.

During the inspection the facility was toured inside and outside. LPA observed 11 children in care supervised by 2 staff and D1. Six cameras were observed in the facility, 4 inside and 2 cameras outside in the play yard. LPA observed the cameras to be powered on. L1 and D1 have set up surveillance access to the facility mobile phone and was reviewed by LPA. 4 children have been enrolled since the last visit and those files were reviewed and contained video camera recording notice/parental consent and signed LIC9224. LPA also reviewed the 2 child files from last visit and verified missing documents were received.

Four staff files were reviewed, revealing that L1 and D1 has complied with section F above, completing a 12-hour course in child appropriate discipline and supervision techniques on 12/29/25.

Additionally, LPA observed training certificates for D1 and L1 in Managing Early Child Daycare Education completed on 1/20/26 for D1 and 1/21/26 for L1. This training course was an 11-13h training course. This meets the requirement of section H above.

Additionally, S1 and S2 has completed the annual training (8 hrs) on 12/31/25 for S1 and 12/20/25 for S2 as required by section H above. The training was called Early Childhood Discipline and Boundaries which was a 10-12 hour course.

The 8 hour annual training requirement must be completed annually from the effective date, 9/2/2025, of the Stipulation and Waiver.

LPA recommends D1 complete a course related to stress intervention/anger management to satisfy the requirement of section G above. D1 will start a course immediately.

D1 understands that violation of any of the terms and conditions of probation relating to its stay of license revocation shall constitute sufficient grounds for the revocation of the probationary license.

All licensing reports are public information and must be made available upon request for at least three years.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with the Director, Tamara Kinman.

There were no Title 22 deficiencies cited during today's inspection.
