At 9:50am on 6/13/2024, Licensing Program Analyst (LPA) Matthew Gallo met with licensee Sharon Dykes-Lee for the purpose of an unannounced required 1-year inspection. Upon arrival, LPA observed a total census of 13 children, consisting of 3 infants, 9 preschool children, and 1 school aged child. Licensee's two adult assistants were also present for the inspection.

Licensee guided LPA on a tour of the facility, and a health and safety inspection was conducted in all areas accessible to children. Off-limits areas include Master Bathroom and Garage. Licensee acknowledged that children must never enter these areas. LPA observed the required postings, a working phone, 2A10BC fire extinguisher, and functioning smoke and carbon monoxide detectors. Per Licensee, there are no weapons in the home. LPA observed an above ground pool in the backyard to be fenced according to regulation. Toxic and hazardous items are inaccessible to children. There is neither a fireplace nor staircase in the home. Outdoor play space is fenced.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA reviewed 13 children’s files and observed them to be complete. A current roster is being maintained and fire and disaster drills are documented. Current CPR and First Aid certification was verified and expires 6/2025, and AB 1207 Mandated Reporter Training was verified for the Licensee and expires 8/2025. LPA reviewed personnel files and observed them to be complete.

During the inspection, LPA observed an infant sleeping in a play yard with objects laid across the top of the play yard. Through interview, licensee stated that the objects over the top of the play yard had been placed there to keep the infant from climbing out and disturbing other children. Licensee stated that the parents of the child were aware of and okay with this practice.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

A Type A Title 22 deficiency is cited on the accompanying LIC-809D.



Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided.

Based on observation and interview, the licensee did not comply with the section cited above in the case of an infant sleeping in a play yard that had objects laid over the top of the play yard for the purpose of keeping the infant in the play yard.
