13 | Licensing Program Analyst (LPA) Christopher Bello met with licensee Hannah Garity to close a complaint. Upon arrival, LPA observed eight children including four of licensee’s minor children. Also preset was licensee’s roommate. LPA Lea Habton conducted the complaint investigation. During the investigation, LPA Lea Habtom toured the facility, conducted observation, and interviewed those pertinent to the investigation. It was alleged that the licensee consumed alcohol. LPA Habton interviewed the reporting party and the licensee and discovered that the licensee consumed a beer while daycare children were present. It was also alleged that the licensee left daycare children unsupervised. LPA Habton interviewed the reporting party and the licensee and discovered that the licensee allowed 2 daycare children and 3 of her own children to ride bikes around the gated community while the licensee was in the home. The route was done twice, with no adult supervision, once in the morning and once in the afternoon, and lasted about 10 minutes. Based on the information gathered, LPA Habton concluded that the “Licensee consumed alcohol during work hours, impairing their ability to provide adequate care and supervision, which presents a risk to children.” and “Licensee left daycare children unsupervised.” allegations are to be SUBSTANTIATED: meaning that the allegation is valid because the preponderance of the evidence standard has been met. A civil penalty with a amount of $500 was assessed.
Licensee stated that the daycare children’s mother agreed and allowed her children to ride their bikes around the block without adult supervision with her own minor children. Licensee also stated that she only had one beer after daycare hours while caring for one family.
Title 22 deficiencies are cited on the subsequent page of this report. Type Acknowledgement forms are to be signed by current parent of the facility and new parents for the next twelve months. LIC 9224 and Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Licensee, Hannah Garity. |
