Licensing Program Analyst (LPA), Dean Thompson conducted an unannounced Case Management visit for the purpose to discuss the Lead Sampling re-testing conducted on 06/09/2023. LPA met with Sister Cecilia Duran (Director) and Assistant Principal Allison Spillman, who was explained the reason for today’s visit. There were no children present at the time of visit.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires all licensed Child Care Centers (CCC’s) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five years after the date of the first test.

Lab report analysis water from Site ID F taken on 03/29/2023 indicated 6.02 parts per billion (ppb) levels of lead in exceedance. The faucet on the sink was replaced and the faucet was being flushed daily. Facility was issued a Plan of Correction on 05/01/2023 and retested Site ID F on 06/09/2023, which resulted 6.040 ppb Action Level Exceedances (ALE).



Community Care Licensing was notified that lead water testing conducted at the facility on 06/09/2023 failed the allowable limit for lead. The Purpose of today’s visit is to follow up on the lead re-testing results of Action Level Exceedances (ALE).

Facility staff was advised on 06/29/2023 that the Lead Sample Report was to be posted. LPA observed the facility had posted the Lead Sample Report.

Director met with a water testing analyst consultant on 6/22/2023 to discuss the second test failure, they will be replacing piping underneath the sink. Director stated they are flushing three minutes per day for three weeks per request of water testing analyst consultant. Director mention the sink is used for cleaning purposes.

On 06/09/2023 licensee failed to maintain a lead value at or below the Action Level for water lead testing resulting with values of 5.5 ppb or greater for Site ID F. Water testing results identified with Action Level Exceedance as defined in WD section 101700.3. are not deemed safe to drink.”

In the areas that were evaluated, one Type B deficiency was observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Please see LIC 809D for 101700.3 California Lead Action Level at Child Care Centers.



Exit interview conducted and report was reviewed with Assistant Principal Allison Spillman. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Appeal Rights discussed. Assistant Principal was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

Testing results with fractional ppb readings of less than 0.5 ppb shall be rounded down to the nearest whole number, before comparing to the Action Level. (2) Licensees shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care.
