On 08/18/2026, Licensing Program Analyst (LPA) K. Navar conducted an on-site inspection for the purpose of an Annual Random inspection and Increase Capacity. LPA met with Director Shelley Burnett, and together they toured the facility indoors and outdoors. Floor and yard plans were verified. Census was taken in individual classrooms. The overall census observed was 2 preschool staff and 0 preschool children. Director stated that children do not come back from summer break until September 8, 2026.

A review of the Facility Personnel Report Summary indicated that all staff and individuals requiring caregiver background checks have obtained the required criminal record clearances or exemptions. This is a parent co-op program. Facility hours are 9:00 a.m.- 3:00 p.m. Monday through Friday. Program schedules are as follows: Mon. -Fri. morning sessions 9:00 a.m.- 11:30 a.m. Tues./Thurs./Friday (extended day) 11:30 a.m.-2:00 p.m. and Wednesday there is a STEM day 11:30 a.m.-2:00 p.m.

The facility is currently licensed for 24 children in rooms 101 and room 109 and is requesting to add 24 children with an overall increase capacity of 40 children. An approved Fire clearance was received 08/10/2026 with an approved capacity for 40 children in rooms 101, 106, and 109. Director stated facility is only requesting for classrooms 101 and 109 to be licensed with an overall capacity of 40 children and that room 106 will not be used by the licensed facility Tustin Community Preschool.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Room 101 measured a total of 690 square feet and Room 109 measured 943 square feet, which is sufficient for the requested capacity of 40 children. Room 101 has 2 sinks and Room 109 has 1 sink, and there are 2 bathrooms located in the hallway between Room 101 and Room 109 that have a total of 4 sinks and 3 toilets that are available for children to use.

Indoor activity areas were observed to be clean, safe, and well maintained. All detergents, cleaning compounds, medications, and other potentially hazardous items were stored out of children’s reach. No poisons or hazardous materials were stored on the premises. Food is not prepared on site; authorized representatives provide snacks and lunch from home, Parents are assigned a day to bring snacks for children in morning session. Children who attend the afternoon session bring lunch from home. Menus were posted where they could be reviewed by parents. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. There is drinking water available to children indoors by a filtered water system. Children’s cups can be refilled as needed. Sports bottles/cups with the child’s name on it are brought from home. The children's bathrooms are clean and sanitary. Children do not nap this is a Cooperative Preschool (Co-Op) program. The Co-Op preschool program offers sessions in 2.5 hours increments for families to choose from

The facility conducted an emergency drill within the past six months, with the most recent fire/earthquake drill documented on 04/16/2026. A working carbon monoxide detector and operable fire extinguisher were present.

All required postings were observed, including the California Child Passenger Safety Law at the entrance. LPA reviewed LIC 125 with the director, covering required child records, personnel records, administrative records, and mandatory postings. The facility grounds were safe, sanitary, and well maintained on this date.

2 (two) staff files were reviewed. Required health screenings and immunizations were present. As required by H&S Code 1597.622, staff must be immunized against influenza, pertussis, and measles. Proof of pertussis and measles immunization was observed and found to be compliant. At least one staff member present possessed a current EMSA-approved Pediatric CPR/First Aid certification, expiring 03/21/2028. As required by H&S Code 1596.8662, all directors and employees must complete mandated reporter training every two years. All 2 (two) staff files reviewed were in compliance.

5 (five) children’s files were reviewed and found to be complete, current, and compliant. Sign in/out procedures were observed using full legal signatures with the time of day recorded.

The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least four feet in height. The surface of the outdoor activity space was well maintained and free of hazards. Shade is provided via Tree and overhang cover. There are sufficient outdoor age-appropriate toys and play equipment available on the playground. There is adequate cushioning in fall zones of climber provided by sand/artificial grass. Drinking water was readily accessible outdoors through cups or labeled water bottles. Outdoor equipment and toys were in good repair and free of sharp edges. No bodies of water were present.

LPA verified the facility completed lead testing on 01/19/2023. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP).

The director stated no children are currently enrolled who require medication. Incidental Medical Services (IMS) policy was discussed regarding storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Facility Representative was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. “

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

In the areas that were evaluated, no deficiencies were observed per California Code of Regulations, Title 22, Division 12. A license for 40 preschool age children will be granted upon a final file review.

An exit interview was conducted, and the report was reviewed with Director Shelley Burnett. A Notice of Site Visit was issued and must remain posted on or immediately adjacent to the interior side of the main door for 30 days.
